AOS Gross income or Net income???

Ready to fill ou he Affidavit of Support for my wife. I work as a consultant for a Pharmacy and would be getting 1099 from my employer. My question is will he NVC look at my income before taxes or what I make after taxes.

Any insight on he matter appreciated. :unsure:

I think it's line 37 on Form 1040. Someone can correct me if I'm wrong.

One consequence of this that I haven't seen discussed is that any deductions from your paychecks for 401(k) contributions, health/dental/vision insurance, and commuter passes (e.g., for the subway or train) will make you appear "poorer" than you really are for the purposes of the AOS. This is because all these deductions are pre-tax and don't get reported as wages on line 7 of the 1040.

I suspect this actually impacts very few people, since folks who are "on the edge" in terms of meeting the AOS income requirement probably aren't making 401(k) contributions and may have jobs without health insurance. Still, if you're having trouble meeting the income requirement and are making discretionary pre-tax contributions, I'm thinking that it may make sense to reduce them in order to boost the total on line 37 (if you can do it far enough in advance to affect the tax returns you need to submit for the AOS).

EDIT: I was wrong. I just checked and it is line 22 on the 1040. The rest of my post about reducing discretionary pre-tax contributions if necessary still applies, however.
