:help: the uscis has refused to update their their system and its getting back at me.

after my wife paid the lawyer she used for my filling in 2007,it took him weeks to send in my application and she latter called the uscis to withdraw the the case from the lawyer and was told that every correspondence will go her but was not so.

r.f.e was sent in 25th jan 2010 to the lawyer and till now she has not recieved it from the lawyer who was given excuses and it will expire by 25th of feb 2010.

what should my wife do please all vjers kindly come to my aid and tell me how we can take the case out of his hand.

secondly,will like to know if i will still av to pay any fee to the consulate in lagos during my interview.

First your wife needs to respond to the RFE. I've never had one, but I know they come with instruction on what information is needed and where to send that information.

From what you wrote, she is aware that there is an RFE but the lawyer has not given her a copy. My first thought is that she should call USCIS hotline and see if they can give her more detailed info. I know the lawyer is handling the case and all letters go to the lawyer; but she should have a case number where she can call and inquiry about the case. She really needs to find our what is being requested and where to send the information.

If she can't get any where with USCIS on the phone, she needs to go to the lawyer's office and not leave until she has a copy of it. If the RFE expires on 2/25, she has enough time to get the information and send it Express/Overnight via FedEx, DHL, UPS whatever, it will be expensive but if you don't respond to the RFE in time you will be right back at the beginning of your immigration journey.

When responding to the RFE. She needs to keep a copy for herself, you, and I would also send a copy to the lawyer by certified mail. It seems that her lawyer has dropped the ball in a few places. By sending the RFE materials, certified to the lawyer; it demonstrates that any problems that may arise around the RFE situation were not because you wife failed to respond. In addressing the lawyer, I think she should also include a short letter, that expresses her concerns about how the lawyer has handed the cases, and the specific instances, also include the number of times and way she contacted the lawyers office about the RFE. Just state the facts. If I were in your wife position, I would fire the lawyer...AFTER I got the info I needed for the RFE and I would even request a refund of some of the money I paid. But that really depends on how much more time and effort the two of you want to spend.

REESES THANKS A LOT FOR THE CONCERN,SINCE MY WIFE COULD NOT REACH THE LAWYER,SHE CALLED USCIS LAST THURSDAY AND REPORTED BUT ON FRIDAY SHE GOT THE RFE FROM THE LAWYER BY POST AND WAS JUST TO RESEND MY BIODATA INFORMATIONS AND THE TO MY SURPRISE THE LAWYER PICKED IT UP BY HIMSELF ON SUNDAY AS TO POST MONDAY BUT THERE WAS HOLIDAY AND HE SAID HE HAS SENT IT ON TUE AND WILL BE WITH THEM TODAY.

AM REALY AFRAID OF THE LAWYER BECAUSE OF THE STAGE THE PETITION IS MOVING TO,SHE WAS TOLD THAT ONCE THE RFE GETS BACK TO THEM IT WILL TAKE 14DAYS TO GET BACK AT HER ON THE DECISION AND IF MORETHAN 14DAYS SHE SHOULD CALL IN 60DAYS.

ITS GETTING TO A STAGE WHERE URGENT RESPONSE WILL BE NEEDED AND AFRAID OF THE SLUGISHNESS OF THE LAWYER.

THIS IS MY CASE.

SENT IN PETITION 2007 O6/14

RFE 2010 01/25

HOW LONG DO YU THINK IT WILL TAKE ME TO GET TO THE INTERVIEW STAGE AND HOW LONG WILL IT TAKE BETWEEN USCIS AND NVC TO ANWER ME FROM HERE.

SHE COMES TO NIGERIA TO SPEND 3MONTH EVERY YEAR AND WE MEET IN UK,AND CANADA TRICE FROM THE DAY WE MARRIED.

WILL I STILL HAVE A TOUGH TIME AT THE INTERVIEW?CONSIDERING THE YEARS OF MARRIAGE.
