Hello everybody, Just want ask for some info here for my friend.

She's been here in the US for almost 12 years, and she was married for 5 years. Her husband died last year March 2009. She got her greencard last December 2005. Can she apply for citizenship now? She doesn't have kids, she just had her own house.

She is elgible to file citizenship based on 5 years residency and she could apply 90 days before .

February 01, 2010 Filed N-400 Citizenship.

February 08, 2010 Check Cashed.

February 10, 2010 NOA.

February 17, 2010 RFE Email.

February 22, 2010 Biometric Letter Received.

March 03, 2010 Biometric done.

March 13, 2010 Yellow Letter Received.

March 23, 2010 Email ( case transferred to local office for interview.

March 25, 2010 Interview Letter Arrived.

April 29, 2010 Interview (Rescheduled)

May 24, 2010 Interview (Passed)

June 17, 2010 Oath Letter Received

July 14, 2010 Oath Date ...........

July 14, 2010 DONE

If she got her green card in December of 2005, she'll be eligible to become a citizen in December of 2010, and she'll be able to send the paperwork in 90 days before, around September of 2010. She's not yet eligible, but close.

Also note that she's ineligible to file using the "three year shortcut" based on marriage to a US Citizen. It may seem unfair, but that provision of the law is unavailable if the marriage ends for whatever reason (even death of the US Citizen spouse) before taking the oath of citizenship.

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Thanks a lot Lucyrich. We're just thinking that we can apply together coz I got my greencard last August 2006. And I will send my application this 1st week of March 2010.

Believe that law was passed in 1927, congress believed back then that an immigrant married to a USC makes a better citizen so cut the process from 5 years to 3 years provided both spouse were living together. No exceptions to that rule. Sorry about the death of your husband.

I don't think you can send it your application in the first week of March - that's over 90 days before August 2010.

I got my residence in May 2007 and I am sending mine on 3/3/2010 so you have couple more months to send it in.
