HELLO.. I HOPE SOMEONE CAN HELP ME.

I AM AMERICAN CITIZEN BUT I HAVE 3 YEARS LIVING IN MEXICO. I WANT TO GET BACK TO USA, BUT I HAVE MY FIANCEE AND I AM TRYING TO GET A KA VISA FOR HIM.

MI QUESTION IS.. SINCE I LIVE IN MEXICO I DONT HAVE ANY INCOME IN US. I HAVE A FRIEND WHO WILL HELP ME BEING A SPONSOR POR MY PETITION. MY QUESTION IS.. CAN I DO THAT? OR I HAVE TO WORK IN US?

THE SPONSOR HAS ENOUGH INCOME TO SUPPORT HIS FAMILY AND US.

I WILL WORK IN US.. BUT RIGHT NOW I HAVE A BUSINESS IN MEXICO.

No need to use capitals.

Marry him and do a DCF. LOT faster. Yes you have to use a sponsor.

Really?..It was my first tought.. but someone told me that the k-1 visa is faster than the k-3?.. I will do whatever is faster.

Because I have a 14 year old daughter (american citizen from my first marriage) and she will start high school in August 2010. And I want to go with her, but I dont want to leave my fiancee and my baby (I have a baby with my fiancee..he es 8 months). I tried to get the Certificate Report of Birth Aboard for the baby but I did not qualify because I am not married with his dad, then I am a "single mom" for that purpose. And I had to stayed in USA for 1 year continuosly.. And I always came to Mexico in Christmas.. so my time un USA wasnt continous.

Anyway.. thats why I think on getting a K-1, k-.2 visas for my fiancee and our baby.

DCF is Direct Consular Filing at the embassy. FASTER than K1, K3. It ends up being a CR-1 spouse visa. You file a I-130 at the embassy. You file I-130. Separate ones for you and the baby.

You have to have lived in Mexico for at least 6 months.
