I filed married jointly last year and it was a complete nightmare!!!!!!!!! We used his Peruvian name (father's last name and mother's lastname) and his ITIN to file last year. Anyway, now I am having problems efiling my 2009 taxes, I think because my husband's name changed when he came into the USA (they dropped his mother's last name on his green card) and he received a SSN. So I am wondering if anyone else is in the situation and if I will have to amend last year's taxes to reflect his current last name and new ssn number. I am using turbo tax if that helps.

USCIS *CR-1 Visa*

2008-07-26 : I-130 Sent

2009-04-02 : Interview at Embassy in Lima, Peru Approved

2009-04-08 : POE Atlanta (256 days from sending I-130)

USCIS *Removal of Conditions*

2011-02-28 : Mailed I-751

2011-03-02 : USPS Delivery Confirmation

2011-03-10 : Check Cashed

2011-03-11 : Touched

2011-03-25 : USCIS confirmed they did not mail NOA 1, given case number

2011-04-05 : Infopass appointment passport stamped with I-551

2011-04-19 : Walk in Biometrics completed (2 weeks early)

2011-05-03 : Biometrics appointment (3 year anniversary)

2011-08-25 : Approved

2011-08-31 : Card in hand (184 days after sending I-751)

*Application for Naturalization*

2012-03-24 : Mailed N-400

2012-03-26 : NOA1

2012-03-29 : Check Cashed

2012-05-14 : Biometrics Appointment

2012-06-04 : Interview Letter

2012-07-09 : Interview in Raleigh, NC (Passed)

2012-07-20 : Oath Ceremony (119 days after sending N-400)

no amending needed... just file using SSN going forward

ya - first time filers have nightmarish issues when efiling.

He is a first time filer, because:

1. first time use of SSN

2. ITIN name not match SSN name

Suggest you paperfile, instead, but have the monies direct-deposited.

Don't worry to 'fix' the names problem for now - is huge nightmare and red tape, might take several months.

So - file paper return THIS year, using 'SSN name' - and

NEXT YEAR, should be no problems.

A call to the IRS found the solution. They said he had no income last year with his SSN.

Somewhere in the e-file part, it should ask about last year's AGI (adjusted Gross Income) and how you filed last year.

I ended up with this:

I indicated that we did not file together last year. I don't remember if it said single or what, but use separate.

Then I was able to put in an AGI for me and one for Manuel.

I put the total AGI from last year as my AGI.

I put zero (0) for Manuel.

The IRS accepted the return with no problems.

After another conversation with IRS at an office, they really don't connect the ITIN with the SSN.
