Finally, the K1 visa is in my fiance's hands!!!!

Now, I have a question about her traveling to the US. She plans on coming here in April. She also knows she will need to travel to Brazil (her home country) in September/October for a few weeks. In general, round trip tickets are a better deal than one ways. Is it a little fishy for her to come to the US with her K1 on a round trip ticket? Do you think this will cause problems?

Why would anybody care about something like this?

No fishy business in returning to her home country.. is not going to be a problem as long as you process her adjustment on time.

On the other hand consider the following: I don’t want to be the negative one from all the prior responses, but consider the following.. your K1 visa is one way to the US, please everybody, correct me if I am wrong. You have 90 days to get marry from day of entry.. then Adjustment of Status, Advance Parole and work permit process.. this means [to me] my fiancée can't travel outside the USA [after entry] without an authorization from the USCIS [Advance Parole]...

It takes between 60-90 days for your AP to be authorized [Estimated #s based on other reviews] - if no complications or REF. After getting her Advance Parole Approved, then she can travel outside the USA with no complication to return. Please consider any delays, as they can add 30 - 60 days on top of your original timing process..

--- Just Memo to consider as I am in the situation, I had plans for our honeymoon but cant do it until the AP is approved..

Yes!

As 'im waiting' says, she CAN NOT travel to Brazil without her advance parole in hands.

If she leaves the country she'll have to start the process all over again, but this time with CR1 (spouse visa).

Be careful.

The OP question is:

If it's fishy to come to the US with K-1 on a round trip ticket.

The answer is:

NO, it's not fishy. K-1 Visa as any other Visas guarantee your entrance here and no one can force you to stay here, you can go back home anytime. No one even care about your ticket, I came here on a round trip ticket and no one even notice, no questions at all.

The extra infos are:

- IF she go home on a K-1 visa prior your marriage you can't come back to US, you would need a new visa.

- IF she go home after your marriage, you must have your Advance Parole to be able to come back to US. And for that you must have your AOS.

- IF she go home on AP, the plane ticket must be in her maiden name because the name on the ticket and the passport need to match.

The OP has the information and can read the guides and do some research to be able to make his decisions. About timelines, I have ever heard that my Visa won't take less than 6 months and in 3 months I had it in hands, so, getting the infos and working on it, if you start your AOS in April, you may have your AP in hands due September.

A...The spouse cannot re-enter the US unless they have "advance parole" authorization (application form I-131).
Advance parole allows you to re-enter the US before approval of Adjustment of Status
. Without advance parole approval, leaving the United States is considered an abandonment of your application for Adjustment of Status. Without advance parole approval, the USCIS (INS) will consider you an intending immigrant without a valid visa, and you will be denied entry. If you do not apply for advance parole when you file for Adjustment of Status, contact your local USCIS (INS) office to find out how long it takes them to issue Advance Parole. Although advance parole is supposed to be issued to anyone who wants it for any reason at all, some local USCIS (INS) offices may take weeks or months, and may require proof of a serious emergency.

If you have left the US without advance parole approval, you will most likely have to apply for a "spousal visa" (I-130 Petition for Alien Relative) to re-enter the US. This can take months. Any other legal remedies through US Consulates will be time-consuming as well.

Current policy is that Advance Parole applications are sent to a national address for intial processing. In some cases your local office may accept these applications. It is worth calling them to check if this is possible. If so they be able to process the application faster. In emergencies a local office is able to process them locally without having to file the application with the national address. Contact them for more information.
