Hi all, just wondering as spoke to our attorney last night im a in uk and a citizen my husband a usc he says at moment if husband files i-130 it abt 5 months and then i can go? does this sound correct as looking around it doesnt to me??

is your usc with you in the UK and you are filing at the embassy then maybe

else if your usc is out of UK and filing will be at service centers in the US then 5 months is pretty optimistic. it varies. for me it was about 14 months.

left US on dec 28 to avoid meeting the substantial presence test for IRS

Jan 9 2010 entered and activated green card though PHL port of entry

waiting for SSN requested with DS230 and 10 years GC

01-30 received tracking number for GC Welcome issued on 01-27

but not yet SSN

SSN expected by Feb 20 else I might go and ask for one regardless of DS230

GC expected by March 27

Feb 3 2010 update card ordered says to allow for 30 days

Feb 8 2010 update saying approval notice sent

Feb 12 2010 received GC card Permanent resident valid till 2020

Feb 18 2010 went to file ss5 for ssn card as not yet received and center would not find me in ssn files

^^ I would agree. If your spouse is filing from the US 5 months is very optimistic. I would expect 9 - 12 at the minimum, start to finish.

CR-1s usually take around 6-8 months.

Look at my time line to see how long the process took my husband and I last year from Peru. The time will vary by embassy and country of course.

The length of time varies from case to case according to its circumstances, and cannot be predicted for individual cases with any accuracy. Some cases are delayed because the applicants do not follow instructions carefully. Sometimes the petitioner cannot meet Affidavit of Support requirements. Some visa applications require further administrative processing, which takes additional time after the visa applicant’s interview by a Consular Officer.

For UK, I would say that the 6-9 months is probably as good a guess as any (of course non RFE or AP situations).... If you are filing DCF in the UK, then 5 months is possible...
