Hello Guys,

I'd like to ask you about my case. I applied all forms and documents as follows:

1. I-485

2. I-765

3. I-864

4. G-325A

5. W2

6. IRS-1040 (2008)

7. Marriage Certificate

8. Copy of Non-US citizen passport biographic page

9. Copy of non-immigrant visa page

10. Copy of I-94 front and back

11. Copy of two pages of vaccine supplement pages (stamped with the medical personal) MMR second dose in US

12. Check with $1010.

The date I mailed is 02/02/10 and USPS delivery is 02/05/10, until now I not yet get any notice of receipt from USCIS. And I went to SSA office (being almost 4 weeks of SSN application)and the officer told me the immigration office not yet verify them. And plus told me to wait more longer. What should I do?

Thanks for you guys' helps!

It is still too early to worry about NOA. If they delivered it on the 5th, then they didn't receive it until Monday the 8th. I would expect a NOA next Thursday or Friday.

Yap, Now what I should do is sit and wait.... I forgot to say (birth certificate also included in applications.)

One thing what I want to know is what is my status now? My I-94 will be expired in 3 weeks. After it expired, what my status will be, overstay?

Thanks for your suggestion

Sit and wait - take a deep breath - and try to start enjoying your new life. :star:

Your status would be 'Pending' once the I-94 expires because you've filed your AOS (etc).

** Topic may be better suited in the "AOS Case Filings/Progress Reports" forum; moving thread there.

Hi Congratulations on receiving your NOA.

To answer this question, for future readers, there is nothing wrong with your I-94 being expired. You have currently applied for AOS and your status is pending, which makes you legal in the US until a decision is made.

Pretty much nothing you can do for now. Most states need your I-94 to be valid for a certain length of time to get a Drivers License so with yours expiring they probably won't allow you to get it until you have something else proving your pending status (some states will let you use your EAD for example, and give you a Drivers License with an expiry date that matches that on the EAD, which can be extended once you get your greencard.) SSN usually won't do anything if you have less than 2 weeks left but if you already started the process and they are just waiting on the USCIS checks to come back, you will just have to wait until they finish it. Basically just have to sit back and relax till you get your EAD or Greencard to do that kind of stuff now.

All will be fine, just breathe :D

You got NOA for biometric earlier. I have to relax for waiting.

Thanks for suggestion.

Congratulations on your NOA1's for both the AOS and EAD (that's great), so you know they have them and can relax.

You may need to return to the SSA to find out exactly what the status of your card/# is - did you apply using the same last name as the visa was originally?

Yes, I applied SSN name as the visa was. All the applications are using the same name. I visited two times to SSA office and they told me if Immigration office verify them, my SSA card will be in the mail. Till now, nothing in the mail.

Thanks in advance for further suggestions.

this is a problem.

your POE date is 2009-12-02

go back on Monday, tell the clerk to get a supervisor.

Once you have a supervisor - tell the supervisor you are K-1 visa, and look you up in the SAVE database.

You don't have much time left - the window closes at day 74 of the POE date.

IMO - the person that 'processed your application', did it wrong.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
