Hello All!

My wife came to the US in May of 2007 on a K1 Visa, and her daughter followed in October of 2007 on a K2. Both have their conditional green cards now. It's almost time to file I751 and I see that if they file at the same time, I only have to pay $80 for my stepdaughter's biometrics. However, my stepdaughter is not and will not be in the 90 day window to file until after my wife's 90 day window has expired. We filed for the green cards about 6 months apart.

$545 for my wife and $545 for my daugther, that's a lot of money. I know, I know....I'm preaching to the choir:) LOL

Since her daughter is a K2, I've seen similar cases where you only have to pay biometrics when it is time to apply for ROC since you paid for your wife.

However, since their green cards were not approved within the same 90 day window of time from each other, unfortunately, yes, you will have to pay a separate ROC fee for your daughter as well as she can't be processed on her mother's ROC application.

Due to delays in my step-daughters' AOS processing we made the I-751 for her by the skin on our teeth. But they are going to get another 675 bucks from us for her USC. Makes a person wonder if they have a guy working for the USCIS that looks at applications, hey, if we can delay this one by a couple weeks we can pocket another 545 or 675 bucks!

USCIS is so critical on applicants dates, send your application in a day early and it's rejected, under 18 for tailgating USC, least it's up to 21 for the USC petition, over, and you have to wait another ten years. And why are kids conditional? Maybe if you have problems with your spouse and want to get rid of her, that kid may be in the same situation and want to get rid of him/her too.

But the USCIS sets up the game rules, at times you think they make up the rules as they play the game. My step daughters' conditional card was delayed by 63 days even though I applied at the exact same time. But if there is penalty for a longer delay, it's out of my pocket. USCIS does not make errors.

To follow up to my own post:

I made an infopass appointment to speak to an immigration agent about this. While they did confirm the "rule", and said I would "probably" have to pay two seperate fees....the officer told me to go ahead and file them together and include a letter explaining the situation. She said there was a 50/50 chance that it would sail through.

I guess that's better than nothing :thumbs:

You like to have this strange notion that you are a family, with a new life and all living together and helping each other. USCIS has a strange way of isolating each member of that family.

I had this strange notion that I was the head of my family, I brought them here, and all the evidence we presented had my name on it. If any fraud was found, would find myself paying a $250,000.00 fine and spending five years in prison. But as far as the USCIS was concerned, I was nothing. My wife and daughter were new to this land of freedom, getting the ####### scared out of them with our first visit to the USCIS office with all those armed guards hanging around. With constant threats of being deported.

Probably a bit hard headed myself as a veteran of a foreign war expected to give my life for our freedom. What freedom? But would get on the phone and say, hey, wait a minute, THIS IS MY FAMILY!

And we sure were all guilty of fraud, until we proved ourselves innocent, apparently the USCIS never heard about our US Constitution nor our Bill of Rights. Most difficult part for me, was being nice, but sure wondered exactly who our enemies are.

Well,the results are in....

I submitted my wife's I751 with a check for my daughter's biometric fee. I explained in a letter that my daughter followed my wife but wasn't in her 90 day window yet, yada yada yada.

About two weeks later the check for my daughter's biometrics was returned with a letter explaining that we need to submit a seperate I751 with full fees.

So, if you're in the same boat, I can say that it won't hurt to try, but it didn't work for us.\
