On 03/17/10 my husband's current green card expires. I was notified in December to send this form and payment, however things have been really tight around here and we are in a situation where we need tax return money to pay for the filing. The question is, do I strain our finances and suck it up and send it in ASAP? Or is it OK to wait another week or so? We live in AZ, I don't know if that changes how the timelines look for us. Preferably, he's without a GC as little as possible as he is currently applying for jobs. Any advice is welcome.

You need to apply asap , otherwise uscis will start deportation proceedings , dont mess up your case uneccesarily

Your submission needs to be received prior to the GC expiration. If there are any issues with the submission (e.g., incorrect payment) they could send it back to you and you would still need to get it in on time. My advice would be to send it as soon as possible and not risk a problem.

Whatever you do, just make sure you submit the I-751 application and allow USCIS to receive it before the GC expires. Once they receive it, they will send your husband an extension letter for an additional year, and he can use it as proof of work and travel eligibility. Everyone is in the same boat where the fee is too darn expensive, but we need to suck it up and pay :angry:

You will have to file to California Service Center and they are processing applicants pretty fast, so you should get your approval from them within 2 months after filing.
