Husband got job back

My husband was laid off on Ocotober 31st of 2009 because they were rebuilding the company and laid everyone off. The company has restarted and they gave him his job back the other day. My question is i need to get my papers off this week i can't wait for him to have a pay cheque to add to the I-864. My forms are already printed off and they say he is unemployed on the I864 so should i just attach a note explaining he got his old job back because of the rebuilding of the company or what should i do? It is so annoying to have to go back to office max to reprint papers lol.

What would i say though because he won't have any proof that he is working there. He can only work a certain amount of hours anyways because he receives SS every month. So would i attach a letter stating that he receives SS as well as working part time, or should i just leave the SS out. Also should i include how much he gets from SS in the box where it asks your total annual income?

You can ask his work/HR department to write a letter stating how much he gets paid, his hours and his job title etc. My husband did that as well as providing pay slips etc. Not sure what to suggest about the SS but someone else might be able to help with that.

Have you guys got a co-sponsor? Will your husbands income be enough to meet the requirements?

It is in your best interests to file the I-864 correctly... This form is required for most family-based immigrants and some employment-based immigrants to show that they have adequate means of financial support and that they are not likely to become a public charge.

Agreed. Change the I-864 to show he is employed. If you do not have the supporting documentation yet, submit the I-864 without the copies of paycheques, etc. You will receive an RFE (Request for Evidence) for them and by that time you should have what you need.

Ok i just can't afford to wait any longer to file the papers now that they are all done. I will just send it in with stating that he has a job and if and when they do send that i will have the stuff to prove he is working. I do have a joint sponsor although i don't think we need one with his SS and his work income but if i am omitting his SS then i do need a joint sponsor so i don't know what to do.

It wasn't a problem it's just the HR department is stationed in Texas where his whole company is based. There is no place he could walk into here and get someone to do that, he would have to phone and someone would have to send it in the mail. They did e-mail him his position how much he will be making and his job duties, so i was thinking i would just print that off and send it. It has his electronic signature on it.

Include the SS as well. If you feel more comfortable attaching a letter explaining the circumstances of the lay-off and that he doesn't have any recent pay stubs yet but will shortly, then do so. You want to show that he has income to meet the Affidavit of Support. If you state that he meets the requirements but don't include the proof, they will send you an RFE for the proof, which you should have by that time.
