Here'she the situation. I am a resident of New York. Now while filing for AOS, my wife the sponsor submitted the Affadavit of Support. SHe was working at the time and we were covered by her employer. Since we recently had a baby, she had to quit her job and I am unable to find one. New York state offers health insurance free of cost to those who are unable to afford it. My wife and my child recently got their state insurance. Am I eligible to apply for one. Somebody told me that I am, and the Affidavit of Support binds the sponsor for food and shelter only. I don't want to apply for it and later on complicate my case which still has to go through the removal of conditions. I can do without one if I am not eligible for it for now. ANybody has any suggestions. Would appreciate your advice.

I suggest you look up section 122 of the New York State welfare law. If you collect any means tested benefits provided by the State of New York, including medical assistance, then your sponsor (your wife) will be held liable to reimburse the State.

Some states don't enforce the affidavit of support against a sponsor. Some others do, but only in certain circumstances. New York has actually codified into law that it WILL enforce the affidavit against the sponsor.
