Hi there,

a question about the DS 230 part 1 form. I noticed on the example form, the form didnt list the name of the spouse. For the name of the spouse, you write the name of the American spouse....correct?

Also, for line 31a. Do I write the name of the American spouse as well? for question 31a and 31b, it gives you two choices. I am a bit confused as to which one I should fill out.

31a says; Person named in 14 and 29 who will accompany you to the US now.

31b says; Person named in 14 and 29 who will follow you to the US at a later date.

Even though we are applying for my visa now, and want to move to the states as soon as possible (and together), does this mean that I am to say that we are going to the US now? or at a later date?

Any info would be great!

Whenever you are asked about your spouse, give the name of any and all spouses. In a CR1 or IR1 visa case, the visa applicant should have one spouse only and they better be a US Citizen. Otherwise your visa will be denied. The answer to 31a and 31b is "None". Your US Citizen spouse is not immigrating. Only foreigners immigrate to the USA.

No, the question is for when the immigrant visa application is used for the US Citizen's other relatives, not their spouse. Regardless of where a US Citizen lives, they will not be immigrating to the USA. If the USC's parents are applying for visas, then they would each list their spouse in that section. In short, it's for when a couple is immigrating.

Regardless of where a US Citizen lives, they will not be immigrating to the USA. If the USC's parents are applying for visas, then they would each list their spouse in that section. In short, it's for when a couple is immigrating.

great. thanks! I really appreciate all the advice and im sorry if I am asking this question, but....actually, we are both living in Japan so wouldn't I have to write his name because we would be coming to america together? (even though he is a US citizen?)

I agree. I think you should put your spouse's (the US citizen)'s name as the questions does NOT ask "who will be IMMIGRATING with you". It asks who from Question #14 (in which you listed your spouse) is ACCOMPANYING you. Since you are both in Japan and he will be accompanying you when you go to the States, I think it makes sense. I am in the same situation. I am USC living in Mexico. We will both go to the States together once he gets his visa. We also have a daughter who we listed in Question #29 so when it asked who will be ACCOMPANYING him to the US now, I put both my name and our daughter's.

Good move to the DCF forum -- I can see that its presence in the IR1/CR1 forum was causing some confusion. :rolleyes:

While pushbrk's answer may be correct if the USC spouse and/or children are in the US, for most DCF couples this will not be the case. jaremedios is right -- the question is about who is ACCOMPANYING you to the US. In 31a, you write the name of your spouse (and any USC children); 31b is N/A (unless your spouse and/or children will be flying back at a later date).

The question says nothing about spouses immigrating; it is about accompanying. Sometimes it helps to read the form itself to assure oneself of the terminology and then consider the context in which the OP is asking a question (here: DCF) before posting.

Okay, so to reiterate:

I-the USC spouse- write myself on the 31a line?? Taking into affect that I do live in Brazil with my husband and we will both be moving to the US at the same time?

Accompanying: A type of visa in which family members travel with the principal applicant, (in immigrant visa cases, within six months of issuance of an immigrant visa to the principal applicant).

Doesn't sound to me like they want you to list people you are just travelling with (ie: people not listed as visa applicants)
