I'm going to apply for fee waiver request for I-485.

The poverty guideline is $10830 a year, which is $905.5 a month.

So my question is, if i have income more than that, does it mean that i'm automatically not eligible for a fee waiver?

November 25 2008 RFE #1 received [good faith + good moral character].

January 7 2009 RFE #1 sent back.

I did not even see any mention of being able to request a waiving of the fees on the I-485 instruction sheet. Maybe it is not allowed although refugees and asylees are exempt from the fees.

Maybe try calling the number of the National Customer Service Center. 1-800-375-5283. It is a toll-free call.

I do not think anyone has tried this.

No, you are still eligible as long as you can show USCIS that the money you earn is enough only to cover your living expenses like food and bills and that you don't have an opportunity to save money for stuff like AOS. Send them copies of your bills.

Question is how will you meet the minimum poverty requiremenrs for the affidavit of support?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

That is what I think. I do not see how you canb request for a waiver based on such low income when you will need to file I-864 to show you will not become a charge of the state.

The OP is a VAWA case. She does not need an affidavit of support, as this is not a marriage case. She will file an I-864W to show that she is not required to have one.

To the OP - no, you will not automatically be rejected. The USCIS makes fee waiver decisions based on all of the financial data about the applicant. I have no idea whether you will be accepted. And you can request a waiver for the I-485, since you are a VAWA case.
