Who do I have to contact if he left me?

Hello Everyone,

This has been such a heart wrenching process but this is by far the worst part yet...

My fiancee came over on January 14th... Things are so different now, I dont know what it is about him, but hes never happy and not the same person I thought I was marrying. We have had the worst 3 weeks I have ever had in a relationship with anyone.. but anyway here is the deal.. We have had a few talks about if this was the right decision for us, and I mentioned that maybe it wasnt the best idea we get married if we cant even get along.. I told him we should talk more about it and decide what we were going to do because his I-94 expires on April 14th. Well, I got home today from working two doubles in a row and all of his stuff is gone... He isnt answering my phone calls and I guess this was his answer to us not getting married. I am beside myself.. but now I have to start thinking about ME. I know he is my responisbility while being here in the US. And if we decided not to get married, I was going to make sure he was out of the Country by April 14th, so he wouldnt overstay. But, hes gone... he obviously didnt want to go back to the Philippines and figured that being "on the run" in the US was a better option. What are my duties now as the USC? I should report this, im sure but to who? If anyone has any information they can help me through this, would be greatly appreciated. Im sure I will be interviewed and everything by immigrations once they realize April 14th has passed and we didnt get married, and he is still here. I'm not sure if I was used from the start or what... but all I know is that he is gone and I have no way to get a hold of him.. I have no idea where he is. He has friends all over the country.. he could be anywhere. Thank You for your help, this is such a hard time for me.

The first thing is to do the right thing and contact The immigration office and let them know about your situation and follow their instructions!

Feb 5: Interview date scheduled. Interview on March 23, 2010

Embassy Journey 1.0

March 23, 2010: Interview date. Wife placed on AP, Baby required new birth cert.

April 21, 2010: Wife out of AP she needs to get an approved I-212 from USCIS, Baby birth cert. issue resolved.

I-212 Waiver @ USCIS Journey

May 10, 2010: Filed form I-212

Sept. 9, 2010: I-212 Approved

Embassy Journey 2.0

Sept. 22, 2010 New Interview date.

Sept 22, 2010 VISA APPROVED.

Waiting for visa to arrive at Cali-Colombia.

I don't recommend doing anything until after his I-94 has expired.

Cover your Azz Megan.. be sure that you are safe and secure first.. then that your assets/finances are safe and secure... try that DoS # tomorrow and ask them what you should do regarding him and his immigration status....

I'm so sorry that things have turned out this way. It is a good thing that you didn't get married but found this out before marriage. Send a letter to USCIS listing his name, A number, date he entered - all the details like that, and then tell them what happened and let them know that he has abandoned you and you have no idea where he is. Provide them with his phone number as well even if he isn't answering your calls.

He is here legally until April 14th and no action will happen until then. He may decide to leave the country, although from what you say that doesn't appear likely. He has no way of remaining in the US legally, though, as he can only adjust his status through you.

It is very unlikely you are going to suffer any repercussions with immigration because of his actions as you too are a victim of his act. If you ever want to sponsor another individual to the US, however, this event will definitely come up and will have to be addressed at that time before any further immigration benefits will be granted.

Again, I am sorry that this has happened.

One of the first things I would do is CHECK whether he took any of your cheques or cards or ID documents or anything like that. If in doubt contact your bank and let them know. If the phone is in his name, or he's on your bank accounts, have him removed.

Aside from that, do what Kathryn said above about contacting USCIS. After his April 14 date I'm not sure what you should do.

I'm sorry all this happened but at least you know now, and not after you married him. Best wishes for your future.

Very sorry bout your dilemma.

1. Contact USCIS/DOS/Immigration office and seek advice.

2. Call the law to circumvent a possible scam and get ideas how to protect yourself.

3. (myb better) Change the locks and secure your sheeyat (assets/cars/finances).

Thank You for all of your replies. So, the DOS is the person to contact? I understand he is here legally until after April 14th but I want to let them know what is going on ahead of time, just so they dont think anything fishy intentionally went on. He isnt on anything of mine yet, no bank accounts, cars etc. I dont even know how he is living day to day.. we requested a SS# for him, but it hasnt arrived yet. I too, am glad this all happened BEFORE we were married... I will wait a few weeks to see what happens, but to be honest after all of this, i definitely do not want to marry him if he decides to come back. I just am so worried that hes going to think its OK to come back AFTER april 14th has passed. I dont want anything to do with that.. I just want to start moving on with my life now. So much money and time wasted with this its rediculous.

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

So, the DOS is the person to contact?

Probably not. "DoS" is "Department of State". They are the government department responsible for the foreign consulates, and the ones who issue visas. Once the foreigner arrives in the US then they are under the jurisdiction of Customs and Border Patrol, or CBP. Once they apply for immigrant status, then they are under the jurisdiction of US Citizenship and Immigration Services, or USCIS. Both CBP and USCIS are under the Department of Homeland Security. Department of State deals mostly with aliens when they are outside the US. Department of Homeland Security deals with them while they are in the US.

He hasn't done anything illegal yet, so there's nothing really to report him for. If he stays beyond the expiration of his I-94 then he'll be out of status, and illegal. You have no legal obligation for him at this point. You didn't marry him, and you didn't sponsor his application for a green card. There is no way he can obtain legal status in the US without having done these things, since he entered with a K1 visa.

At this point, you should probably just wait until his I-94 expires. If you haven't heard from him by then, you can send a letter to USCIS and let them know that you didn't marry him, and you don't know where he is.

He could have came there on a visitors visa if he was planning to 'run'... Obveously he has left because of the problems you guys were having.. I would not contact any deparments until you are SURE that you arn't going to get married. If things suddently improve, then you may just regret reporting him as a possible scamer or whatever.

Umm, its not really this "late time" hes only been here 3 weeks. I dont know what it is, im not going to report it as a scam. I just want to know what to do so I dont end up getting screwed any more than I already have. I work for the State Police and I dont want any of this coming back to bite ME in the a**.

So, once the I-94 expires, HE is held responsible for still being here... not me? Thats basically all I really need to know.

visitors visa is very ,very hard to get from the philippines,he scamed her!!!!!!!!!! hello
