Important:

Please show this information to your spouse/asawa because you may want to discuss this with your accountant or CPA to see if it applies to you. If it does, you would want to become a US citizen. Please refer to 1st sentence under note.

General:

You must complete Schedule M and file it with the return if you claim a deduction on Part 5—Recapitulation, item 20.The marital deduction is authorized by section 2056 for certain property interests that pass from the decedent to the surviving spouse. You may claim the deduction only for property interests that are included in the decedent’s gross estate (Schedules A through I).

Note:

The marital deduction is generally not allowed if the surviving spouse is not a U.S. citizen. The marital deduction is allowed for property passing to such a surviving spouse in a qualified domestic trust (QDOT) or if such property is transferred or irrevocably assigned to such a trust before the estate tax return is filed. The executor must elect QDOT status on this return. See the instructions that follow, on pages 29 and 30, for details on the election.

This was actually one of the considerations that helped me in making my decision to take out US citizenship. Estates are definitely taxed differently if you are a Permanent Resident than if you are a US citizen - and not to your benefit. IRS believes that a non-US citizen surviving spouse will leave the country and take the estate with him/'her so tax it at the death of the US partner to make sure they get their 'fair share'.
