I think you can do it online :) check the website of sf consulate.

My plan kasi is to make sabay na the ROM and passport renewal (which requires personal appearance). Asenso na rin pala kasi ang Philippines at may biometrics na rin. So kailangan talaga mag-fly pa talaga. 18-hour drive din ang SFO from where I am. But I really have to do it soon because my passport is expiring in September. Haaayyyy ulit.

The spouse is still a citizen of the Philippines. The Family code (law) of the Philippines requires the filing of the report of Marriage. Therefore it is not optional.

Would appreciate if you can please cite the provision in the Family Code that states that filing of the Report of Marriage is a requirement and not optional.

Maybe Philippine Government should do something on this. I would call it cheating when somebody goes to the NSO and request for CENOMAR when in fact the person was married overseas but neglected to file a report of marriage while abroad.NSO should not grant any request right away and make a little investigation if the person is really single or not.

[/quot

The NSO will never give you any certificate indicated that you are married abroad if you never report your report of marriage at the Phil. Consulate abroad because I did that before I get here in the US, if you requested for a CENOMAR they will gave a certificate that they don't have your record on file, and the DFA will never accept even authenticated marriage certificate from US unless from NSO copy of you marriage certificate, but I don't have any idea about renewal of passport with the same name with marital status (married), she need to double check with NSO and DFA, good luck to OP...

True. While it may not be required by law, we strongly encourage reporting your marriage to the embassy or consulate nearest you.

From the Philippine Embassy website.

REGISTRATION OF MARRIAGE

REGISTRATION OF MARRIAGE OF FILIPINO NATIONALS

The Family Code of the Philippines provides that “records of marriages whether performed by the Philippine Consular Officer or by the local religious or civil authorities shall be kept and transmitted to the Philippine Civil Registrar through the Department of Foreign Affairs” (Sec.664 of the Philippine Foreign Service Code).

"Records of marriages x x x shall be be kept and transmitted" is entirely different from "citizens are required to report their marriage abroad".

Not to belabor the fact and the above notwithstanding, I am not advocating for Filipino citizens not to report their marriage. Again, I strongly recommend reporting our US marriages for the said marriage to be properly registered and recorded with the Office of the Civil Registrar General in Manila.

No offense, but I think I will follow what the Philippine Government says and not the advice of a lay person that certainly won't represent me when not complying causes me some unexpected problem down the road.

If you read again, I was not advocating non-reporting. I even bolded "I strongly recommend reporting our US marriages."

That is like saying, "You are required to have a drivers license by law, before you drive. So, I strongly recommend you get one before you drive." It is a law, you either comply or take the chance of suffering possible future consequences if you dont. Admittedly, in this case the chance of consequences is small. But still not worth taking the chance in my opinion.

But if I don't want to drive, I won't need a license. It may be the law but if I have no use for it, why even apply for it? But I would strongly recommend to get a license, just in case, for emergency reasons. Having a driver's license is optional, not compulsory.

At any rate, we are going nowhere with our discussion and we are getting off topic.

My apologies to the OP.

To WorriedPinay2, it's always nice to have good debates like this. It's very stimulating. Peace! :star:

To Godsgift,

If the Pinay does not filed her marriage with NSO, she is technically single in the philippines but this does not give her the right to get married again. I'm trying to prevent other people getting an idea that if a marriage in US is not filed in NSO, the pinay could marry another person in the philippines.

I agree on some of the things your mom's friend says about marrying abroad, but on the validity, your mom's friend should add that under the philippines law, any marriage solemnize outside of the philippines render the person still married in the philippines. If she did not report her marriage, her main problem is the documentation of her marriage.

Kahit saan pa ikinasal ang isang tao, kasal pa rin sya kahit saan sya pumunta.

Very trivial...It would be funny if the validity of marriage is only recognize on the country you got married... if my hubby goes to japan, he is single again since he is not married in japan. If my hubby and i would visit europe, we could not claim we are married coz we were not married in europe. :bonk:
