k-1: don't appeal if it's denied

Timeline

This is from my experience. The whole time since the day the Consular rejects my K1 petition, it said that I will get a chance to appeal. 3 months of waitting to hear from 'em, I got nothing... Until yesterday, in the letter of The Homeland Security Agency to me, it said that I might want to start refile. There is no appeal process period! What a lousy SOB! Now I'm back to square one..

i'M SO MAD :crying:

This F-ing agencies (USCIS & HLS) won't stop those million illegals from South America but they decided to stop people like us who want to come legitimately & legally.

I agree with you on the illegals living here & the fact they make it difficult for people doing it the right way.

Don't give up.

8/2/2021:  Mailed N-400

8/4/2021: N-400 received

8/6/2021:  Biometrics to be reused
3/15/2022:  Interview (successful)

Timeline

It is depends on the service center. VSC frequently reviews K1 returns and CSC declares them expired and tell you that you are free to resubmit a new one.

This will not be over quickly. You will not enjoy this.

Just got a RFE for my I-130 Appication today. AAAAAAAAAWwwwwwwwwwwwwwww i sent 600+ pages of evidence. VERY VERY frustrating. I feel your PAIN. My dad was joking the other day and said, YOU should get her to Mexico, then she could be here in a week. HOW TRUE and HOW SAD for those of us who are TRYING to follow the system. :angry:

That's actually GOOD news! That means you don't have to wait for the long appeals process, and potentially have a finding of material misrepresentation against your fiancee if your appeal is denied, in which case you'd need to apply for a waiver in addition to having to file again. Even if your appeal was approved, in all likelihood it would take longer to get your petition reaffirmed and sent back to the consulate then it will take you to file a new petition. At this point, you're free and clear with USCIS, and can proceed with another petition.

Don't delude yourself about the illegals. If Vietnam shared a border with the US then we'd have 20 million illegal Viet Kieu here instead of Mexicans. Poverty is very strong motivator when a better life waits just on the other side of the Rio Grande.

Yeah, that's probably true, but there would be no way for her to legally get a green card once she got here, unless she wants to claim that you beat her after she got here. VAWA is the only path to a green card if you enter the US illegally. :blush:

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Same thing happened to me, I was in Vietnam when my fiance got her interview and when they denied her I asked to speak to someone about it and they told me paperwork was already sent back to the US you have to wait for a response. I got the same response as you, you can reapply at any time >_<!!
