Hello,

This is not the right place to ask this question...but i thought you guys are experienced and can help me....

I was arrested for taking the post mail from the girl i dated for 3 months. When the police arrested me, they found some of her emails(i took it) and maps to her address. The following day, i was issued an Order protection and then within 15 days, i was given a Permanent order protection for 2 years by one judge in one court room. No phsyical abuse or anything. I was charged with stealing her mails.

Regarding the criminal case for taking the mails, i plead guilty to Tresspassing to land and i was given supervision for 364 days by another judge in a different court room on May 15, 2009.

Will this Restraining order and criminal conviction of tresspassing create any issues while i go for my next H1B stamping?

The restraining order is not because of the criminal case.........these are 2 different cases.

That could fall under "moral turpitude" - which could result in a denial for the visa.

I would recommend a lawyer.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

There are several things it could be

Stalking

Mail theft which is a federal offense I think.

Both may cause heartache and the OP would be best advised to seek the advise of a legal professional not a bunch of forum junkies

IMO, yer H1B will not be renewed.

Hopefully, you'll be told to 'go home' also.

Basically, you've committed a crime whilst here on an H1B visa.

'Stealing the Mail' is a big thing, normally a federal offense.

'Stealing an email' is different, different set of laws about it.

The protective orders are 'sideways outcomes', usually, of something larger.

You were arrested for something, then charged with something, then found guilty of something.

I note the 3 are different, IMO you were lucky to 'just' get hit with 'trespassing'.

what does the court document say , specifically, on 'guilty of something' ?

Talk with your attorney who was at your trial, find out which category of offense it was -

misdemeanor

felony misdemeanor

felony

and also tell us what type of court you were in?

city, district, federal, state, etc.

You really don't want to stay here, do you, and keep working? Many other countries will take you on OFW programs - Malaysia, France, Greece.

Thanks everyone for the reply. Here are the details

Charged with Theft..........Class A misdemenor....But when i went to city court, i plead guilty to Tresspassing to Land...which is a misdemenar class B.

Tresspassing and Restraining order are not crime involving moral turpitude (CIMT)

I was not charged for Stalking or Theft...

No i was not convicted of Mail theft or domestic violence. I heard that you can be arrested for anything, but only conviction counts.

So now, will the restraining order and tresspassing will create any problem. Please let me know.

I have to disagrea with the comment forum junkies ,

as the people on this journey has helped so many here ( including myself )

has it not been for VJ many here would have been denied ,

but yes i do agrea a lawyer might be able to help too
