Hi, I am actually a illegal immigrant who is living in US, California for almost 8 years.

I filed a I-130 form about 2002 in May, with my sister being a perminant resident in US.

Thats almost 8 years since I sent the I-130 in to the USCIS.

My FIRST question is... Online, I have checked my statues and it had said that I am in the Post-Decision Activity stage.

It had said that: On August 8, 2005, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice. But I did not receive anything for them. I want to know what I can do from now on because this was about 5 years ago.

My SECOND question is that I would like to know the approx. time it will take from Post- decision Activity stage to Document production or Oath Ceremony.

Lastly, (out of all question I think this is my most important question) I came to America legally with a tour visa which expired long ago.

I would like to know if the I-130 case will still work for me.

did u receive any NOA2 in the mail in 2005 when it was approved? it is likely that you have your approved petition at NVC waiting for a VISA number which usually takes over a year. first thing you need to do is to call NVC and determine if your petition is still their. as regards your legal status in the U.S and your approved petition, I hope you find some1 here with the correct answer, perhaps you may be able to adjust status if you interview in the U.S. Some Canadians have posted here before stating that they were able to adjust status after years of overstay (by marrying USCs), I am not sure if the situation only apply to Canadians. Call NVC and determine if your case is still their or if it has been returned to USCIS due to abandonment (this can happen if you miss any of their correspondents and u are unaware of it)

TOUCHED AND APPROVED 12/23/09. THE LORD IS FAITHFUL ALWAYS

NVC: CASE COMPLETE: Feb 3rd, 2010

INTERVIEW: Mar 12th, 7:00 a.m : APPROVED

POE / ARRIVAL: Washington D.C. April 8th.
