which is the best route to bring my other half

Hi folks,

First of all i would like to thank everyone for contributing and help guide new members here. This site is awesome!

Please help me i am totally confused, We got married in December of '09 and she is currently in Nepal. I have heard that for I-130 there is a 2 years waiting and that is too long to be apart. What would be the best approach to this situation, so we don't have to wait for such a long time to be together. Should i just file for I-130 then K-3? or just I-130? I am reading all these different posts and finding out that it's the same.

File I-130 and wait or its wise to do both?

I appreciate your help in advance... :-)

K-3 is obsolete as it normally gets approved on the same day as the I-130. the CR-1 is far better vs the K-3 anyway. As long as you have a normal case you should be approved and with each other in a year or less. Most CR-1s are approved within 6-8 months if you look at the timelines.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I am little skeptical about our situation here that is why i didn't wanted to take any chances. I was in Nepal for only 4 weeks and due to on going political issues i couldn't register our marriage while i was there so now our marriage certificate has a later date that i wasn't even there. we had traditional marriage, which is not recorded anywhere besides the pictures and family member.

I am afraid that might cause issues. I am not sure what to do at this point.. so figure filing for both might help her get here fast .. have you heard of same kind of situations? i am in need of some advice here ...

Your kind of situation is fairly common among us Pakistani applicants actually...in our cases the pictures of the wedding and the certificate(even if it is registered later) usually suffice as good enough. Rarely have I heard of problems with that. But I wouldn't know how it works for nepal embassy...but people usually get through nvc well enough.

I may be prejudiced but I believe I-130 is the way to go. But if your not sure...why not try both and see which seems better when they throw out interviews?

The K-3 has been abolished from February 1st, I believe. So file for I-130. You should be done in 6-8 months if you're a USC. LPR's take years, which might be what you heard.

Talked to my sweety today and instead of mailing copies of her birth certificate, passport and marriage certificate (Phew! finally!) she is scanning them and sending it as an email attachment. Do i have to notarize these docs? or they are good since it's already prepared in English.

Wow I didn't know they were doing away with the K3 visa. Makes sense, but what about all those that are still in AP for k3 visas? There seem to be quite a few. I wonder if they will grandfather them in.... :unsure:

The new rules do not apply to those who applied for a K-3 before February 1. Now the new rule is that if approved I-130s and I-129fs make it to NVC at the same time then NVC will consider the K-3 to be administratively closed and carry on with the CR-1.

Those applying now might as well just file the I-130 as the K-3 is now officially obsolete.
