Hi every body,

My wife want to apply her nephew. He lives in USA but with no legal status.My wife is US citizen. Can she apply for him if yes then what will be the procedure. He is 16 year old.

17th January 06----I-130 Approved

NVC

6th March 06------- Receive DS3032 letter (in Pakistan)

10th March 06----- DS3032 sent back to NVC

20th July 06------- Receive duplicate DS230 packet

14th September 06-----Case completed and sent US embassy Islamabad

ISLAMABAD EMBASSY

7th November 06----- Embassy upgrade my petition from F2A to IR1.

8th November 06----- Receive packet 3.5 through TCS.

16th November 06---- Embassy receive packet 3.5 and pending for review.

18th January 07----------- Receive Packet 4.

26th March 07------------ Medical Done

29th March 07 ---- INTERVIEW AT 8:00 am

APPROVED ---------- AP Starts

13th July 07 --------- AP END RECEIVE VISA

a USC cannot directly petition for aunt, uncles, cousins, nephews or nieces, grandparents, etc.

There is no way of applying for a nephew directly. She'd need to apply for her sibling, ie the parent of the nephew, and it';ll take years for them to get the visa. One option to look into may be a student visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

There is no way of applying for a nephew directly. She'd need to apply for her sibling, ie the parent of the nephew, and it';ll take years for them to get the visa. One option to look into may be a student visa.

How would the student visa help? The nephew is already here in the USA but apparently some question to the legality of his status. A visa would require a departure and the moment that happens then a possible re-entry ban

how old is he?

is he older than 18? It depends on the age and if it would trigger a ban.

Read the OPs post - nephew is 16.

Actually there was a post about this a LONG while back.

Unless the child is an orphan (and some other standards) even if he IS adopted, it won't count for immigration reasons.
