I got am email from New Mexico DMV which said this:

"If she is relocating to New Mexico, she would have 30 days from the time she established residency to change her DL to New Mexico."

And earlier an email from New Mexico DMV which said this:

"Her license is valid for 160 days. Her license must be current and not expired."

It is my impression that a foreign person can drive in New Mexico for 160 days with their license (assuming reciprocity which Ecuador has). However, if you are establishing residency then you only have 30 days before you get a NM drivers license.

It is my understanding that a K-1's status evolves as follows:

Non-Immigrant (From entrance until AOS approval)

Conditional Permanent Resident (From AOS approval until I-751 approval 2 years after AOS)

Permanent Resident (From I-751 approval until naturalization with N-400)

Naturalized Citizen (From naturalization indefinitely)

If my above understanding is correct, at what point has my fiance "established residency" and subject to the 30 day requirement to get a New Mexico drivers license? I have heard others from other states state that the EAD is what they needed to get the license, but to me it seems like you would need conditional permanent residence status.

Thanks for the help!
