Hello everyone!

Due to the blessing of God i got married on January 16th 2010. I love my wife and i want her to come to the U.S. as soon as possible. However, there are a few things that worry me. First of all im not quite sure what the fastest way to get her here is, i know that i have to file a i130 and upon receipt i can file an i129F spouse, but since 02/01/10 there have been a few changes and i dont know what to do now. Also FYI i am a US Citizen

The things that worry me are,

A) in the past 3 years that ive been working, in 2007 i made 15k in 2008 i made 27.5k and in 2009 i made 20k and 2.5k in medicare (Short term disability).

I know that ive met the minimum poverty requirement, but nonetheless i want make sure that i will be ok with the filing of the i130.

B) i dont have a joint account open at the moment, but will be opening it soon (in 10 days, i will file after i open it). Her father gifted us a house in india which is under both of our names, will that be enough to be covered as an asset for us AND will it prove a bonafide relationship?

C) I have copies of boarding passes and my tickets and proof that i went to the Airline office in India.

D) I have a marriage certificate from the State board. is that ok?

E) Pay stubs, i dont have 2 from every month i have

2 from august

1 from september

2 from october

2 from november

2 from december

none for january

2 for february (when it comes to the end of this month.)

F) i also have an employment letter stating that i am FULL time which is 32-40 hours and that i have been employed at my employer since 10-2-07 and my current wage.

The process.

I understand im supposed to file an I130 and im going to submit my i130, I864, Copies of my 2009-2008 tax return (should i submit 07?), (no IRS transcripts? how long does it take to get them and should i?) i have 1099 for 2009 and 2008 (cancellation of debt). do i have to go to an interview? what are the biometrics?

I have proof that i made ATM withdrawals in india, i have photos of the wedding, i have photos of us in random places. I have my boarding pass, ticket etc.

I have emails going back and fourth (which i prefer to not submit)

Am i missing something or am i ok? Please advise me of anything, tell me what i should do or if i am missing something.

You are getting way ahead of yourself with the affidavit of support. Just file the I-130 and proof of bonified relationship (marriage). You dont have to worry about the I-864 for about 3-6 months from when you send your I-130 in. You will be ok with the evidence that you have mentioned. FWIW, the only proof of bonified relationship that we had was our marriage certificate, pictures of the wedding, and 4 affidavits signed by my wife's family that was at the wedding. we got approved.

As far as transcripts...it takes about 2 weeks give or take a couple of days. You can call the IRS and request them. You have plenty of time for that. You wont need the e-mails at this stage of the process. There are people that are more familiar with the consulate in india to give you more insight on the process.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Hello everyone!

Tax transcripts for 2007, 2008, 2009 would be great. You can get them in a couple of weeks. The tax transcrips,,,,Form 4506-T is the form. Do a yahoo or google search to find the site. Use the PDF version, fill it out and hit , print, or just fill it with pen. There is no costs for the transcripts.

Congrats on the wedding.

For now, just file the I-130. With the required documents like the forms and marriage certificates, and a few basic bonafide relationship evidence. We used six pictures (3 from the wedding, 3 non-wedding), 3 support affidavits (his dad, my mom and my uncle), our wedding invitation card, and our joint bank account statement. I think that was about it. Ours was approved in 118 days without an RFE. Which consulate will you be interviewing at?

So as far as the I130- we will be submitting the BRAND new bank account that we opened together, a statement from there even though it will open in the next 1-2 weeks, if its a brand new bank account does it matter?

Then about 15 pictures of us.

What should the affadavits say? i have about 10.

Wont i be denied because of my 2009 income?

i made 20k almost 21 but my medicare was 2.5k and it was about 23.5k that i got, but the year before i made 28k and 2007 i made 15k, wont that make it look bad? i have no assets...aside from the house in india that was gifted to us, does that help me?

What is the DS-230? Is that after the consulate says my I130 is approved? Im sorry im really lost on the process, any guidance is highly appreciated.

Shes from Hyderabad, so it has to be Chennai...or they opened a new consulate in hyderabad, i dont know if that conducts interviews, im sure it doesnt so it has to be Chennai.

What is an RFE?

and i know its a stupid question what is FWIW?

Don't worry about the financials now. Then come into play at the NVC stage. If you don't qualify as a sponsor, get a joint sponsor. It can be anyone, relative or not, as long as he or she is a LPR or a USC.

I know im not to be worried about the financials, but i think thats the thing im stressing out about the most, i mean i make OVER the poverty limit, would i really be denied because of my financials? do they check your credit and stuff? I prefer not to get a joint sponsor, but really im freaking out. 2009-23k 2008 28k 2007 15k. But 2 years i have consistently held above the poverty rate so i should be approved right?

I think $19,000 is the 2010 poverty limit, so if you're making $23,000 you should be okay, in my opinion.

Also, another question is,

Does the Affadavit of a bona fide relationship have to be by a US Citizen or by people in india as well?

You can get from both parties. Best to have more from the USC side.

I have 10 support affidavits. 8 are USCs and 2 from my mom and my uncle.
