Timeline

I got married to a US citizen and he applied me for a green card. I already got work permit and we are having an interview next week. But before this, I was overstayed J1 student and been working illegally by using my SSN that indicated "valid with work authorization only" for about 2 years and a half. I even paid my taxes last year. But I said in my application that I was unemployed. My immigration lawyer told me to lie and not to say that I have ever been working since my visa got expired. All joined documents that we have are mostly under my name - he joined my saving account and so on. Obviously it looks like I've been working anyway.

1 Do they have information that i paid taxes last year from IRS?

2. This february my husband filed his taxes seperatly. We did it on purpose - so INS can't see that I work. But now I am really worried if I should lie. I've had like 10 different jobs during that period. Why my lawyer does say me to do so? Can't they check that I actually work and finally this lying will be a result of my green card rejection?

You have an immigration lawyer. I would fire him and find someone you trust to represent you.We are always told never to lie.

your overstaying and working without permission is automatically forgiven at AOS. It is a non-issue; it does not matter, nobody will even talk about it. Вы понимаете?

What they really don't like is lying. In fact, lying to Uncle Sam is a big no-no. So ignore the ill advice your lawyer gave you and if asked at the AOS interview about whether or not you have worked please tell the truth, and only the truth. Most likely they will not ask you about it at all, as it doesn't matter, but take this as a lesson, a very valuable lesson, and don't ever lie to those people again.

Hello everybod, I have a solution for you. It is just simple if you do not filled out the IRS taxes together with your spouse or husband, you do not send the income taxes return. It is not obbligation to send that! of course, if you have that evidence where it appears both join together, it is peerfect to add that up, but if you do not filled out the taxes together, you can send other evidence, and please do not send that! or else you can be inside the mouth of the wolf! I tell you right away, I didn't fill out the taxes with my wife, we always filled separatedly both taxes during the 3 years of marriage. Therefore, do not send the taxes where you are going to put on easy bait for the officer, thank.

I would re-iterate that Just Bob has given the best advice. While you are not required to submit tax returns for the AOS, you are required to file a tax return in the US if you have earned income in the US and have been residing in the US for more than 6 months whether you are legally present in the US or not. Tax residency is different than immigration residency. While it may not come up in the AOS process, if you are asked if you have ever worked in the US without authorization or overstayed a visa you have to answer yes. Lying could lead you to a denial and a ban on returning to the US. Working without permission and overstaying a visa are forgiven when the AOS based upon marriage to a US citizen is approved. Lying is not. You would be well advised to get a different lawyer. Any lawyer who advises you to lie is obviously not trustworthy.
