SSN for VisaWaivers???

Timeline

My brother's wife came from Australia with the VisaWaiver program. Her I-94 expires on Feb.17, 2010.

Can she apply for Social Security Number before her I-94 expires???

PS: My brother has already filed for her and already has an appointment for fingerprints.

So your brother's wife came on a tourist visa. Can not get a SSN with a tourist visa.

Is that what the visa waiver program is for? Only for tourist? He told me his wife came on visa waiver program, I'm not sure if that means she came as a tourist.

she came to visit her husband though. they got married in Australia.

Regardless of the reason - tourist/visitor/business. No SSN for VWP entrants - there is no basis to issue one.

As was advised in the other post, read the back of the I-94W. You cannot adjust status from WT/WB. The petition will (if CIS is doing their job) be denied and if you don't find out that it is denied until after February 17th, that will be your problem because you already knew when you signed the back of the I-94W form. You acknowledged understanding and compliance with the restrictions of the visa waiver program when it was signed.

For those of you who haven't read the O.P.'s "other" post with the same question: his brother's wife, married to a US citizen, used the WVP to fly to the US, and now wants to adjust status to an LPR.

I explained to him that this is visa fraud, a documented one. While some people have lately pulled off to arrive on a VW, marry "totally surprisingly, out of the blue" and then file for AOS, that's not possible in his brother's wife's case as she was already married when she used the WV.

In the former case, I.O.'s often don't pursue intent, as it is very difficult to prove, but if somebody leaves a clear trail of misuse and fraud, I'm sure they will jump on the opportunity.

I also already answered the question regarding the SSN thoroughly before. Looks like the O.P. from Ghana with an sister-in-law from Australia doubts that she and his brother planed and executed a really a bad move than can be a total dealbreaker for the two of them.

Exactly. The successful cases of AOS from visa waiver/tourist visa involve getting married while on the visa, not already being married. Proving you had no intent to stay with your spouse is pretty unbelievable, as it should be. I mean, life can take all sorts of surprises (like madly falling in love) and people shouldn't be kept apart because of that, but this is a clear cut case of visa fraud. Now, your sister and her husband might have the best intentions, and not realize what they are doing is illegal. However, messing around with the immigration process is a terrible idea, and may make it impossible for your sister to ever come here. Once the USCIS thinks you are being underhanded, all your actions will be viewed suspiciously and you will have a black mark by your name permanently, which just makes anything a million times harder. I suggest talking to a lawyer about this, as if they do try to pull it off, they will need all the help they can get.
