it is based on an 3 yr. ongoing & intact marriage to the same USC as well as three years as a permanent resident. The eligibility date is when you hit the latest of the three year anniversaries of either marriage or residency (OBTW, the USC spouse must also have been a USC for 3 years as well)

On the USCIS site, look up the "M-476" and the "N-400".

The N-400 is the actual document she'll submit to become a citizen. Read part 2. The boxes there provide a brief summary of the criteria. When your wife can check off one of those boxes (probably box A or B), she'll be ready to become a citizen.

Also read carefully the box at the bottom of page 22 of the M-476. She can probably send the paperwork in 90 days before she meets the three years continuous residency requirement, but only if, on the date she sends the paperwork in, she meets all the other requirements.

And assuming your marriage was less than two years old at the time the green card status was granted, don't forget about the I-751 and removal of conditions process.

No. Read the instructions: 3 years + marriage to USC (intact), 3 years of having been a PR (minus 90 days), resident of the district for past 3 months.

Check the "resident since" date on your GC, add 3 years, take away 90 days and you'll have your date when to apply.

It goes on the Date of your P.R Card....Then Add 3 yrs from then...and you can apply 90 days before that 3 yr so 2yrs 9 mths you can apply if you are married to a usc..

3 Yr Rule..

3 yrs of being married to the same USC

3 yrs being a P.R card holder...(look at the date on your card)

You have to be married to the same USC spouse for three years even before you can send in your application, but you can send your application in 90 days before your 3rd anniversary LPR date. Since you got married 18Jan09, and your wife recently received her I assume conditional green card, she can apply 90 days before her third LPR anniversary date minus the 90 days, because by that time, you would have been married for the minimum of three years.
