Sorry for posting questions every otha day :( !! u guys r more dan kind and helpful .. thank you so much!

So now da case is that I got married on k1 visa.. it lasted till 5 months only and after violence ma husband sent me threateningly and fraudulently in ma country, I did not have conditional green-card or anything. Now I want to file for a divorce as he is just cut off himself from me after throwing me in ma country.

Can one one let me know how to get divorce if I am not there in US? wil I b getting divorce from da law of ma country as I am here or his country USA coz we married there and he is there?? What is da law of divorce and alimony? required separation? no fault or what? how to claim for alimony if I am eligible?

I might not be correct but with only 5 months of marriage you will not be getting any alimony after divorce. You might get alimony during the process of divorce till it finalized.

The determination of alimony varies greatly from country to country and from state to state within the U.S.[3] Some state statutes, including those of Texas, Montana, Kansas, Utah, Kentucky and Maine, give explicit guidelines to judges on the amount and/or duration of alimony. In Texas, for example, alimony is awarded only in cases of marriage of ten years or longer and the payments are limited to three years unless there are special, extenuating circumstances. Furthermore, the amount of spousal support is limited to the lesser of $2,500 per month or 20% of the payee's gross income.[20][21][22] In Delaware, spousal support in usually not awarded in marrigaes of less than 20 years.[23] In Kansas, alimony awards cannot exceed 121 months.[23] In Utah, the duration of alimony cannot exceed the length of the marriage.[23] In Maine, alimony is awarded in marriages of 10 to 20 years and the duration is half the length of the marriage barring extenuating circumstances.[23] Other states, including Massachusetts, California, Nevada and New York have relatively vague statutes which simply list the "factors" a judge should consider when determining alimony (see list of factors below).[24][25][23][23] In these states, the determination of duration and amount of alimony is left to the discretion of the family court judges who must consider case law in each state. In Massachusetts, for example, there are 135 Appellate cases in addition to 47 sections of State Statute that shape divorce law. As a result of these Appellate Cases, for example, Massachusetts Judges cannot order an end date to any alimony award. Most alimony awards in the state are made for life usually regardless of the length of the marriage (for marriages over 10 years).[24][26]
