Hi all, quick question to see if anyone has had this happen.

Just recieved an rfe that reads as follows: "You submitted form I-693, Medical Examination and Vaccination Record. However, the civil surgeon certified the exam more than one year before the date the applicant filed the Form I-485. The form I-693 must be dated within one year of filing form I-485."

I called uscis and they say we must have a whole new med exam! we took the vaccination records and had them transcribed by a civil surgeon here and he filled out everything, sealed the envelope and we sent it along to uscis.

The med exam for the k1 visa was done August of 2009 so its within one year. Im guessing they lost it?

Any thoughts on what to do?

if they say you need a new medical then you need a new medical, it's much faster then trying to explain that your medical is less then one years old as stated in the instructions.

They might have lost track of when you did your medical exam...perhaps you can try contesting this?

I've heard this many times over from people who've received RFEs for their I-693. Call the USCIS first to make sure they still have the medical exam, if they do, they can look at the date on it and move on. If not, they should tell you that they do not have it and all you have to do is get another medical exam here in the US with an approved civil surgeon. There is thread in this forum with a list of inexpensive surgeons who do not charge that much for the medical so check it out to see if one of them is close to you.

You don't need a new medical.

We had the EXACT same thing happen to us. Our RFE was issued in error, and was corrected by contacting our congressman's office (you can go through senators too). There is a unit at MSC whose entire purpose is to respond to congressional inquiries. Regular users will NEVER have access to a person who can go and physically inspect your file like this. I doubt even an infopass can get this much information.

Our RFE was corrected and our case moving along in less than a week - shorter than the time it would have taken any response to arrive, let alone be opened and our case updated the "regular" way.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

In my case of RFE it doesn't tell me that my med exam from overseas is been a year. But one more day till its 1 yr when they received my AOS file. On the RFE its asking for my complete copy of med. exam from overseas and if I don't have it to have my I 693 completed by the CS. I did passed my I 693 when I filed but only the completion of the vaccinations by CS. But still RFE and looking for a copy from overseas med exam. Its just crazy that they are asking for the copy of my med exam from overseas when they know that we surrender it in the POE.

So i had my med exam again perform by the CS and paid $300 for everything.

As discussed in other threads, it is possible that they didn't even look in your file turned in at POE. Sorry you had to pay all that money again.
