Greetings,

I'm married to a Colombian national and his aunt and uncle who live in the US are co-sponsoring him since my husband and I still live in Colombia. They have completed the I-864 Affidavit of Support but have put both of their names as the sponsor on line 1 and both have signed. In terms of their personal information like date of birth, etc. they have used his information.

I'm note sure if this is correct and legal or if they are suppoused to sign two seperate affidavits or if one of them is a I-864A?

Can anyone help me?

You would fill out the I-864 for yourself.

Your uncle would fill out an I-864 for your husband.

Your aunt would fill out an I-864A (she is helping the sponsor (your uncle)).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi,

Thanks for getting back to me. I have another question. I think my husband's aunt wants to be a sponsor even though she doesn't make enough to be the sole co-sponsor. My theory is she doesn't want her husband to have the complete legal responsibility. Is it possible to make her the co-sponsor filling out the I-864 and him the I-864A so that they are both sponsors? He does make enough on his own to sponsor my husband so I don't think it works if she completes the I-864A because her income is unnecessary.
