And it's not just a theory that USCIS wanted to relieve the case load at local offices -- I did find that information somewhere on the web. I think it was an immigration lawyer's website.

From USCIS's own statements above, one would think that filing within the 90 days is a requirement for transfer to CSC. But based on your experience, turns out even that is just a theory.

It makes sense that the transfers are done to relieve case load, but why certain cases are chosen over others is seeming more and more random.

I think what it all comes down to is that no one has any idea what they're talking about, including USCIS! :lol:

This is true...no one knows how the USCIS thinks...sometimes I wonder if THEY even know themselves! I do think that approving AOS without the interview for "clean" cases, or cases where evidence is clearly established, is a great idea, even if it doesn't appear to speed things up. The USCIS is one of those "unexplained mysteries" that I seriously doubt will ever be explained and to try and figure it out is insane!

Thanks for that great info. I am a K3 with a very simple case so hopefully when I file I get through without an interview! The only thing that makes me wonder about the no interview cases is if the people are using co sponsors or lawyers.

I do know of a case that was transferred where a co-sponsor was used, so it doesn't seem like that would prevent a transfer. Not sure about lawyers though...

I was transfered to cali on July 10, I didnt use a lawyer, didnt have a co- sponser, and I didnt apply for the EAD, My 14 year old daughter was transfered with me. Who knows why they do it , Im just happy they did. Recieved email today that a welcome letter is in the mail!! 18 days after transfer -way to go Cali!! It would be interesting to find the common link though - if there is one ! Lara

Hi,

My case was transfered on 27 July, i did use a co-sponser, i didn't use a lawyer, i did apply for EAD, so who knows what there reasoning behind the transfer was, i aint complaining though :dance: .

My only worry is why my 2 childrens cases were not transfered with mine.

From what i have read on VJ most people who have applied for AOS for themselves and for their children usually find that the cases go through the process together, were as mine and my 2 childrens seem to have been seperated.

Ohhh well i can live in hope that they get transfered real soon.

It'd be interesting to see if conditional AOS-without-interview cases will get interviewed for their I-751 or not.

I don't think transfers are based on the DO's case load - my DO (Charleston, SC) is currently processing cases from February 2005 which means a backlog over over 1 year and my case has not been transferred to California.

Another girl on here, also from Charleston, was told to expect a 2-3 year wait for her interview (she was told this at an Infopass appointment).

My case is really straightforward - K1 visa, from the UK (low fraud), presidents are good friends, DO has backlog....yet no transfer.

There seems to be no logical answer to why some cases are transferred.

I agree. And it's the same with the approval times, there doesn't seem to be any reason for the totally different time lines either.

So they got approved after only 18 days, while my case was transferred on May 23 and I still haven't heard anything. I also have heard from a German friend who filed months after I did and just had her interview and was approved (thus nixing the "country of origin theory") and from a couple living just an hour away from me who filed slightly later than I did and were approved without interview last week (so, the "local theory" doesn't work either :D ).

Who knows why USCIS does anything? Maybe they sit in their cubicles the entire day and roll their dice: "6" means, transfer to Cali, "5" means "send them interview appointment", "3" means "send them RFE for medical, whether they've already had one or not", etc. :lol:

Sorry for the sarcasm, but I'm just soooo tired of all the uncertainty. It's just been going on for too long (I started the whole process with the K-1 more than a year ago....and yes, I know that others have been waiting longer, I guess I'm just a bit edgy and in a bad mood today :( )

Actually I just wanted to agree to there being no logical reason, but got slightly off track.....sorry :D
