How does one prove they are here legally after the I-94 expires. We are married, I have applied for AOS, EAD, and Advanced Parole. I have my SSN, marriage certificate, and a bank account. Now the Minnesota DMV is saying that I cannot drive after the expiration of my I-94 as I cannot prove my legal status...SSN is not a valid document for proof according to them, and they have all my other stuff...marrige certificate, BC drivers license and my, birth certificate. I arrived here on Dec 9 on my K1 Visa, so on March 9 it expires...we were married on Jan 21, and applied for the AOS, etc last week. I wrote my drivers test and received the license, and then got a llittle note in the mail saying it expired on Mar 9... they said nothing of this when I took the test. I am baffled as to what to do next? :help:

Biometrics done on Apr 21, at St. Paul office..wait some more......

Touched on April 24 and 28

email aproval for AP on May 1

email approval for EAD on May 3

received AP on May 3

received EAD in mail on May 8

start work of June 1

AOS interview in Bloomington on July 19 8am

AOS approved,passport stamped on July 19

as of Dec 10, 2006 still no greencard....waiting and waiting....USCIS says we are approved, and check back in 60 days...no idea what is happening

Dec 18, email stating welcome letter is in the mail

Dec 20, 5 emails saying they ordered production of my new card......

Dec 24...welcome to America letter in the snail mail

Dec 26...GC in hand and all is correct...

05/01/08 package returned wrong form

05/05/08 re-submitted right form to california

05/09/08 cheque cashed

05/28/08 took my two appointment letters and had my fingerprints done

11/13/08 touched and email stating card production ordered and will be sent to me in 30 days

I think you may have to wait until you get your EAD to prove that you are a legal resident. I don't know if that means you would have to retake the drivers test in your particular situation. I would be curious to hear thoughts from others in this forum too.

Some states (or even individual offices, for that matter) will issue a state ID or driver's lisence based on your EAD--but bear in mind that the DL will last as long as the EAD is valid. This is the case in OKlahoma, for one.

I was allowed to use my Canadian DL in the meantime, seeing as it was still valid. When I received my green card, I went straight to the DMV and got my OKlahoma DL.

Since this involves your state DMV it going to be up to them what proves your are here legally. Now as far as immigration is concerned the filing of the AOS and the NOA covers your butt, but you still need Advanced Parole to leave the country and get back in while your AOS is pending.

thanks guys...I thought everything just went a little tooo smoothly...perhaps they will let me drive with the canadian dl, if not....the freedom was nice while it lasted.....appreciate any one elses experience with this.

you have to wait a few months till you get your EAD - that's proof of your legality and you can get a new license with it... hopefully it'll be quick.

so the DMV told me today that if I bring my NOA from the AOS application that should get me a license to drive....so question for you all.....the checks were cashed today from USCIS for my application for AOS, EAD, and AP...will they send me a NOA like they did for the K1 approval? if so how long does that generally take? Thanks gang.

Just an update in case anyone else is going through this. I received the NOA for my AOS, EAD, and AP, in the mail on Friday..I called the DMV and they told me to bring a copy of the NOA for AOS. So I promptly took a copy down to my friendly DMV and they happily extended my driving privelages until August 19, or until I get my EAD..which ever comes first...so there is some effeciency in the system after all, and I am free to drive....Yayyy........now c'mon just let me get to work...

The DMV in California recognized the EAD as a legal document showing legal status so they issued Claudeth an I.D. card. I wonder what people do if they don't file for EAD, haul around their AOS petition? :wacko:
