filing for k1 or k3 question

Hello.

My fiance is a U.S. citizen living in San Diego, CA and I'm from Mexico. I live in Tijuana and have a B1/B2 VISA/BCC, a tourist visa. Do we need to file for the k-1 or get married and then file for the k-3?

You can do whichever you prefer, but if you go for a spousal visa, go for the CR-1, not the K3, it is better as it leads to immediate greencard.

I like the guide that compares the different types of visas and I think that is very clear. You just have to pick the type of visa that works best for you - where you want to get married and what kind of expenses you can handle, whether you want to go through the hassle of getting all the permissions in Mexico...

Yes you can, and you can file the paperwork for the CR-1 as soon as you have your marriage cert, but until the CR-1 is approved, you are still governed by your visitor's visa restrictions, ie you cannot get married in San Diego and then start living in the USA, you will need to go back to Mexico when your visitor visa stay is over.
