RFE for Medical Exam on AOS

We filed our AOS in January and just received a RFE asking for a completed medical exam along with form DS-2053.

My husband did his medical in Romania just before coming over here in October - so I thought I had read here on the forum - this part of the AOS would be combined from the paperwork collected at POE ??

Here is what the RFE states :

You have indicated that last entered the United States as a K or V non immigrant. Please submit a properly completed and signed copy of the medical exam conducted overseas on Form DS-2053, Medical examination for immigrant or refugee applicant for the applicant on form I-485.

If you do not have a completed form DS-2053 please sumbit a properly completed and signed form I-693 report of medical examiztion and vaccination record for the applicant on the form I-485. The medical examination must be conducted by a civil surgeon who has been designated by the USCIS and must be issued within one year of filling form I-485.

Please advise as to what is needed ???

Hi there...just want to share my experience with you hoping it could help. I had my medical last year on March. When i contacted the civil surgeon on my area, i told the CS that i had my medical which is still valid for a year but have no vaccination. I was advised to get a vaccination from local health department coz they dont have the shots the time i need it. So I went to health department and got the required shots based on my age. Then I took the copy of my medical and vaccination record to the CS. He then complete the 1-693 form and sealed it. also gave me a copy of what is inside the envelope. If your husband had his medical copy and vaccine done just bring it to the CS together with his filled up I-693 form. He does not need to undergo medical again or vaccine if its complete. CS will just charge a nominal fee for transferring the data to 1-693.

Or you can fight the RFE and argue you do not need another full medical by asking your senator or congressman look at it.

Hi, from my experience, you won't need the full medical. I had my medical done in October, too. I just had I-693 filled out by a civil surgeon (just the vaccination part) and I filed that with my original application. Hope that helps.

ok thanks - we do not have a copy of his shot records - so this is going to be pretty hard to get another copy of his records and he is terrified of shots

OK, it sounds to me like there are two problems here.

1. They don't have his overseas medical. I suggest that you get into contact with your congressman or one of your senators (call all three, choose one with which to proceed) and have their immigration helper staff look into the matter and see if the medical isn't in his "A" file turned in at POE. If it's not there, you'll have to get a full medical.

2. He hasn't shown any proof of having complied with the vaccination requirements. These are required and "doesn't like shots" isn't going to cut it. Many people have had these already as children, so he can get his parents to find his vaccination records, or he can suck it up have them *all* done again. I would suggest having these done at your regular doctor or at the health department as it will be cheaper than at the CS. Depending on the outcome of #1, you'll take these records and go to the CS to either have them transcribed or get a full medical.

If #1 results in them finding his overseas medical, be sure to ask the immigration helper how to answer the RFE considering that you do need to also supply the vaccination supplement on the I693, but they ASKED for a full medical. Perhaps they will provide something in writing that the full medical was found for you to include in the reply.

I'd just suck it up and pay for another full medical. Convincing USCIS that it's their fault and that you shouldn't need another medical is going to be very, very difficult.

OR, they haven't even looked in the "A" file, which has happened more than once. Remember, K visas are such a tiny percentage of the AOS filings per year that errors shouldn't be entirely unexpected.

I read these RFEs as expecting that the overseas medical should be sent in with the AOS, and that's not the case, the person opening your file has to look up your "A" file turned in at POE, to get the two files together and they might not all be doing that.

We called on the RFE - an you are right about not looking into the A file from poe - we had to set info pass for tomorrow to go retreive the full medical aka ds-2053 from his poe package at our local office and then will submit it with the RFE paperwork - will keep you posted on this process -

He has had his shots when he was a child - was hard getting the records and we should of made a copy of them - we had the interview from hell at the embassy - so did not think of asking for a copy of his shot records

hi, i have the same problem. kinda. i just had my medical exam in Manila before coming to the US, the hospital doing the medical exam for the embassy didn't give me anything but the cd, no DS2053 which i recognized as the form I used when the medical was performed in Manila. i assume everything else was forwarded to the embassy. now i know for a fact that because i am filing the AOS within one year since i got here last November that i will not have to go through another medical exam. i didn't get the shots in the Phils so i went to a CS and got all 3 shots done. i told the doctor that i did not come there for a full medical exam as i have already done it in the Phils, there's no sense in paying for another one. so she didn't do any exam and i just got the shots. paid for it, got the sealed envelope and got out of there. the copy they gave us of the form I-693 is only 3 pages, the front, the vaccination part and the last page where the CS signed, everything else left blank. i noticed that the one i downloaded online is 6 pages long. after filing the AOS package,we got a RFE. and then when we reviewed the receipt we paid to get the shots, well what do you know, they charged us for the medical exam anway.now since we already paid for what we saw on the receipt says immigration physical, i think i should just go back there and get it done, what im not sure of is if they will perform the exact full medical i went through in the Phils with the x-ray and all, coz that might be more expensive, the immigration physical we paid for but they didn't actually administer is only $80. i don't really know why they only filled out 3 pages of the I-693, what i want to know is if the form you submitted was accomplished completely since like me, you also just got the shots and no more further exams. we're already very exasperated from all this process and the unnecessary fees and since you've already done it, we'd appreciate it so much if you could help us. thanks!

Three shots and a transcription for only $80, I think you got off CHEAP! Anyway, for your situation, I think you might get better answers by starting a new thread. In the first post, please type out the exact wording from your RFE. I've posted in several of these threads on what I think you should do, and the first step is not to run out and pay hundreds for a new medical...

You are talking about the "A" file turned in at POE. Is that the number under the reciept number on my RFE? It says "A200######"

Could be. That's how I've seen it referred to on VJ, and that's how the guy at MSC referred to it in the email that was forwarded to us from the congressman's office. I believe that I've read some naturalization applicants have seen their "A" file by the time it gets to that point and it is quite thick, what with the petition, items turned in at the visa interview (+medical), AOS application, Removal of Conditions application and Naturalization application....

I can see how when you send in a new application, it may not always get appropriately married up to the existing physical file that they've got already.

Could be. That's how I've seen it referred to on VJ, and that's how the guy at MSC referred to it in the email that was forwarded to us from the congressman's office. I believe that I've read some naturalization applicants have seen their "A" file by the time it gets to that point and it is quite thick, what with the petition, items turned in at the visa interview (+medical), AOS application, Removal of Conditions application and Naturalization application....

I can see how when you send in a new application, it may not always get appropriately married up to the existing physical file that they've got already.

Hello, I am in the exact same situation, recieved the same RFE stating they needed to see our DS 2053 or an I-693 sent. After my wife's K-1 medical exam was done in Cuidad Juarez, Mexico, we recieved only a disc with her X-Rays, no DS 2053. Couple of questions:

1. In order to fulfill the RFE should we make an appointment at our USCIS office and request the DS 2053 form from her "A" file? Or is my Senator's office a better approach?

2. She has no shot records from MX, and no vaccinations were given at Juarez, but can we have the civil surgeon draw blood to see if she has all the ones that are needed? (She can't recieve any as she is six months pregnant)

3. Then we just send the DS 2053, if we are able to retrieve it, which will satisfy the medical portion, and a I-693 to satisfy the vaccination part?

Or if unable to retrieve the 2053 get a whole new medical done, minus shots or X-Rays, and send off a complete I-693?

4. What will USCIS do if we send an incomplete packet as we cannot recieve shots or X-Rays due to pregnancy; delay it?

You have a lot of good questions, but I'm not an expert about how pregnancy can affect the medical requirements, other than that I am sure that vaccinations cannot be waived without significant difficulty.

Your wife has no records of any vaccinations for her whole life? Just from her own records, not necessarily from the medical? At her medical, she should have been given the DS 3025, which is the vaccination supplement. Is this also missing?

If your wife has no records of vaccinations, and doesn't remember getting vaccinated, then she is likely missing some - even if they are just booster shots.

In your shoes, I would likely go to an INFOPASS appointment and see what the requirements are for pregnancy relating to the vaccinations. Also ask if the medical from MX is missing. That may be a better question to ask from your senators/congressman, but I don't know how INFOPASS compares, just that the congressional worked for me.
