do i use my wifes MAIDEN last name when filing everything ? i-130 and I-485 if we are already married?

all her information is in her maiden name

Use her legal name. If she changed names through marriage then it is her married name.

Use the name as it appears in her passport I would suggest. At our interview the IO changed my last name to my married name and my GC has my married name on it, I don't think you can legally change her last name yet...

I used my husband's last name (my last name after marriage) on the paperwork. Worked great - everything came in the new name no problems. I'd read on visa journey before that you can and the civil surgeon at the immigration medical told me the same. Just make sure you list her maiden name in the other names box on each form.

Also since my passport, visa stuff was in my maiden name I included a copy of the marriage cert with each form - as some times each form is processed by a different person to explain the name change. In case they looked at the supporting docs and were like who is this! lol! Probably not necessary though.

But yeah go ahead and put whatever name shes going to be using. They're used to it.

Good Luck
