Great point about the A# and case #, I removed the attachment and here is what it said. I should have just done this in the frist place, I can't think straight today...thanks for watching out for me!

Hi,

Here are a few additional pointers that you may have already done or thought of but they are worth mentioning.

1. If you send in pictures, it is very important not include the ones that show affection between you guys. If there are pictures of both of you either holding each other or hugging or even kissing, those are the pictures that you need to send. It is important to have a good view but USCIS offers could care less about it. Also, if you have pictures of you with his family or him with your family, include those and specify who's who.

2. About your utility bills: you did mention that they are in your name only, so it may be good to provide them with such things with an angle. If both of you have direct deposits to your joint bank accounts, then it might be a good idea to highlight the deposits (showing that both incomes are coming in, most importantly his income) and also highlight (maybe a different color) if you pay your bills online that the money is going towards paying the bills. Also include the utility bills and explain that they were not part of the initial evidence because of [reason1], [reason 2], etc. Be brief but provide a good explanation.

3. Mortgage: you can also explain that your husband is helping you pay your mortgage but his name is not on it because .... [as an example: let's say his credit score wasn't good or adding him meant an increase in your APR which would be a bad decision to add him for proof of 'living together'].

4. Can you show that your husband is the beneficiary on your 401k, life insurance, etc...??? I saw insurance but nothing regarding beneficiaries. They like these.

I forgot to mention one last thing...

You should, once you are done with sending the evidence, call all your utility companies and request to add your husband's name on them. This will resurface again if he is planning on applying for citizenship. Keep a record of everything and if during his citizenship interview they bring it up, you/he can claim ignorance towards this and show that since you realized your mistake, you have taken the proper action to fix it and you can show that all your utilities are in both names.

I had to argue with one company because they didn't understand why I need my wife's name showing on the utility bill, and they said that her name is in the system. I told them that when I receive my statement, I want to see it there. I had to talk to a few reps until the 'smart' one got on the phone and did that for us. It is important to keep all these documents straight to satisfy USCIS demands.

Did they ask you for original TAX returns forms. I don't know if such a thing even exist because what I have from my previous Tax returns is a paper which was provided to me by my accountant and it looks like a copy of what he did on-line. Is this a requirement to sent original Tax return?if yes how can you get such a thing? How does it look like? I read I-751 instruction and what they asked was copies!?

I believe IO wanted to see you co-habitance. Your house purchase (or deed showing the house was purchased before the marriage) along with an affirdavid from neighboors, explanation letter and copy of DL with same addresses should do it in my opinion.

There is no such thing really. The best you can send them is a tax transcript, which you can get for free from the IRS.

If you send a copy of what your accountant submitted, you'd also need to submit any supporting documents as well (W2s, 1099s, etc).

This is what I think what you should send

1) Copies of joint account statements , no just a few months but atleast dating back to a year , I sent in 2 years of statements

2) Joint Utility bills are very important , its shows bot are living together and paying bills together , they like to see joint financial commitments

3) Emergency contact and other documents which show your husband as step-father ie showing that your husband is a legal gaurdian , school records showing that your husband is step-father

4)Health insurance cards , bills , auto insurance bills having both names

5) 401k statements etc which show the spouse as dependent

6) Get transcripts from the IRS

7) Make sure you send lot of photographs ,with friends and family and not just you and your husband , if possible annotate them as to when and with whom these pictures were taken

Be calm and you will be fine , just take care to send these documents

Lazy morons .. lot of times the case status never updates and rfe's and important comminication are not received , and then these morons end up denying the cases casuing more hardship and pain

Kimberly&Tarek, I wish you a speedy trip through all of this! I am in the same exact boat right now. I don't know what more I can do other than invite them to come stay with us for a while! I believe it will all work out for both of us!

Mehra, most definately send the transcripts! I sent copies and W2s and I'm fairly sure it may be the cause of our RFE!
