I did spend 177 days in the USA in 2009

I was here from August 2008 - February 16th 2009

And then I returned from August 23rd - present day

About the 2555EZ how do you meet the the first or second test to qualify?

I'm curious about this because for people that have been to the US while their K1 was waiting, I don't see how it is possible to qualify.

As far as I know, and understand, Im a bona fide resident of the Netherlands, since that's where I have my citizenship and that's where Im ... home ... Plus the 2 months out of the country in the beginning of the year are tourist based.

That's what I thought too until an accountant on another forum told me this :

The bona fide residence test is subjective and harder to prove. The rule says that you have to reside in a foreign country for an uninterrupted period that includes an entire tax year (Jan 1 - Dec 31). Your intentions are part of the deciding factor so leaving the foreign country to come to the US permanently is viewed as abandoning your residence in the foreign country.

So now I' confused again, wrote an email to IRS to ask about it but of course no answers yet, I guess I'll have to call them and be prepared to stay on hold for hours on end lol
