My wife and I were married 02/28/2009 but the marriage license says 04/13/2009. She is coming here on a CR1 visa and her entry date is 02/19/2010.

1 When does my wife get her 2 year green card?

2 Is there anymore paperwork that I have to do?

3 When does she get her 10 year green card?

Thanks

1) 3-6 weeks after arrival

2) yes

3) you will file the I-751 sometime between the card expiration date minus 90 days and the expiration date on the card.

Ok so I have to do the I-751 when she gets here? Do I have 90 days to do that? When does the 2 year green card start? from POE date or when she gets the card in her hands? When can I start filing for the 10 year green card? Would she get it 2 years after POE or after our marriage certficate date?

1) Resident SINCE is the day she enters... that is the day the card begins

2) For the I-751 you have a 90 day application "window". It opens 90 days prior to the card expiration and closes the day the card expires

3) You cannot file for the 10 year card until she is eligible... see #2

4) see #1... for residency (day residency begins (RESIDENT SINCE)), the date of your marriage is not the determining date but the day she first walked on US soil

Ok I think I am clear on this but let me put it in my own words to make sure I understand it.

The day she walks on US soil they will send her a 2 year green card she will get in 3 to 6 weeks. Since she is walking on US soil on 02/19/2010 her 2 year green card does not expire until 02/19/2012. 90 days before it expires aprx 11/19/2011 will be the soonest I can file a I-751. If I file it in that window she will get a 10 year green card and if it is not filed by the time her 2 year green card expires it is to late.

yes, but the application window will open 11/21/12 (actual 90 days not 3 mos.)

the other item you need to watch for is SSN... if you "ticked" the box on the DS-230 Part II then the SSN should also arrive automatically. If within 30 days or so it has not then you may want to consider a trip to the SSA.

YMMV
