My Fiance is a UK resident, but not a full citizen. She cannot get a UK passport because of this at this time which would be costly, so we aren't sure which route to take.

She is an Indonesian citicizen, and we would like to work on a K1 visa, or even a K3 since I could go to the UK and Marry her, but we are unsure if she would have to go back to Indonesia for this process.

Please advise.

As long as she is legally resident here, you can. She doesn't need a UK passport, just her Indonesian one. K3s are rapidly becoming obsolete, so you would petition for a CR-1 if you were to marry her, but it's not necessary in order to petition for her as a non-citizen in the UK. What's more important is that you are a US Citizen.

i had the some situation for your fiancee

i am egyptian and was living in kuwait and the whole process was throw american embassy in kuwait

So while filling for here write american embassy in england , they send the case to london when get the aproval

She will just need criminal background document from indonisia before her interview in london

You won't need this criminal background check for the time she lives in Indonesia since it's not required / applicable to Indonesia :P

As others have said, if she is legally residing in the UK, she can go through the London embassy. Be sure to use her UK address, because that is what they will use to determine the consulate (not, as you would assume, the consulate you request!)

If she is not legally residing in the UK, then she should go home - the UK has called the UK government to arrest people who are not legal in the UK before - on a recently expired visa, no less!!

I can't speak on the official policy (obviously), but we have noticed in the UK forum that non-UK citizens, or UK citizens not born in the UK sometimes get tougher interviews, require more relationship evidence, and go through AP, so keep that in mind as you read up on the London embassy interview reviews, and I would consider "front loading" your petition, if I were you.

This isn't technically true. It depends on where and how long she's lived in various places after the age of 18, as well as where she was born. The UK requirements for police certificates - thanks elmcitymalvern! :thumbs: - are as follows:

  • UK police certificate
  • police certificate for every country you have lived in for a year or more after the age of 18.
  • police certificate for your country of birth IF you have spent 6 months or more there after your 16th birthday.

It should be noted that this is officially resident, not just visiting.
