Sorry if this has been asked before.....

When filing the I-864, my husband is my sponsor, but as he has been exempt for the past 3 years on his tax statements (from living in Oz and not working), his father is our joint sponsor. Please correct me/answer any of these if you have info for me:

1 - My husband fills out and files an I-864

2 - My father-in-law fills out and files an I-864 also

3 - My father-in-law fills out and files an I-864A

The only part I am unsure about is Number 2 - whether my father-in-law also has to fill out a separate I-864 or just the I-864A

Any help would be amazing!! Thanks

02/11/10 - Hubby (USC) has I-130 interview at Sydney Embassy

02/11/10 - Hubby and I have CRBA interview at Sydney Embassy

02/17/10 - Medical results received

02/22/10 - Police check received

02/22/10 - NOA2/Packet 3 received

02/23/10 - DS230 mailed off to Embassy

02/23/10 - CRBA received with US Passport for daughter

02/26/10 - DS2001 and supporting documents mailed to Sydney Embassy

03/02/10 - Packet 4 received. Application is complete!

03/09/10 - Visa interview scheduled at Sydney Embassy

03/09/10 - Visa approved

03/11/10 - Visa received

03/19/10 - POE Los Angeles

03/31/10 - Greencard received

04/20/10 - SSN received

If father-in-law is a member of the household (i.e. living with your husband) then he needs the 864A.

Please read page 2 of the I-864 form. It explains what happens if your husband doesn't meet income requirements.

Please complete your profile with country of beneficiary.

#1 is correct - no matter what. He'll need to include an explanation of why he did not/was-not-required-to file taxes.

#2 is correct if FIL doesn't live with you guys and/or he's not combing his income with you guy's.
