as for the income not acheiving the poverty level, did you attach your husband's income to reach the required amount, or any other source(co-sponsor)?. if not, this is as good a straw as any other.

your entire situation is a bit of a mess. we are not happy to see some scammer gaining immigration benefits thru manipulation of the system and fraud. we support your efforts to end his free ride.

good luck in figuring out how to arrange an appropriate ending to this saga.

It was only my income, which was at the time probably a mere 300 a week. He was working under the table at the time b/c he didn't have a work Auth, so It was soley on my income...I wonder why it wasn't questioned???

Maybe I don't need to show proof of income until a different stage of interviews, like an AOS interview? We had the stokes interview already and after that I got the approval of the i-130. But at this point we are only waiting on a Master hearing in May. I really can't wait till Monday because then I can get this whole withdrawal process going.

Well, yes... sort of. USCIS presumes that any marriage to a US citizen entered after deportation proceedings have begun is a sham for immigration. This significantly raises the bar for evidence of a bona fide marriage. I'm presuming this is why they had a stokes interrogation.

Sandy, if they get as far as adjudicating your husband's AOS before you withdraw your affidavit, they would probably end up sending a notice of intent to deny based on your insufficient income, and giving your husband an opportunity to find a joint sponsor. He could conceivably do this on his own, and you would STILL be the primary sponsor, in spite of not having adequate income. Don't take that chance. Withdraw your affidavit. He cannot find another sponsor without YOU as his primary sponsor.

And, as Minya's wife said (and I've said it a few times) get a lawyer. This is too important to do yourself. Besides the affidavit of support, there's the risk of a VAWA claim, as well as the chance he might threaten to drag you down as an accused accomplice in an immigration fraud scheme if you refuse to help him.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

What I said in the first post was that he got a license from a different state from which we were living in, AFTER the interview. After we stopped living together - When we had the interview, we LIVED the same house in NJ. After the interview, I guess he thought he was "golden" as another poster remarked, and now thinks he can do whatever he pleases since he already got this far.

And for someone who can't spell LICENSE right, you really don't have room to make any judgments on my grammar. Can you just please stop this? I'm not here to argue about my friggen college education and or my citizen ship status with you, I am only here for some help with a serious situation in my life. I hope you can get past that and either give some support, or please move on. Thanks.

I am soo sorry you ended up with this creep. And attorneys ARE expensive. Consider it an investment ina hassle free future. He could seriously jeopordized your nursing license if he starts with the 911 abusive stuff. Take the preceeding advice, get an attorney, get one QUICK and pull the rug out from under his scammy butt. This is ABSOLUTELY not worth the rest of your life. He he hits you up with VAWA, it could jeopordize your career.

Thank you very much guys! I spoke to an officer at USCIS and he said I can Withdraw the Affidavit of support since we havent had an AOS interview yet. I'm really sad and quite disturbed by all this, especially when at one time you thought u would spend the rest of your life with this person. But, now that I look back, there were some things that were just not right, and many things I sacrificed.. I shouldn't have had to do that if the person truley loved me.

If you want to try and get an attorney's opinion for free in the NYC area try calling in and/or listening to this station >> Link-up Radio 93.5FM. (Not sure how strong the signal is.) There is an immigration attorney on the air most weekdays at noon. I hear him when I am driving through NYC. Some of the situations are really "interesting." Just Google the station. They may even have an online stream.

Off topic: I honestly hope you are joking when you are assessing someone's citizenship by their spelling abilities. A lot of the PhD students in my program -born and raised in the US - would fail immediately.

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

Yes it can, but neither way includes the way you spell it. The options are: license, or licence. Australia uses the "licence" version, and the US the other version.

"Thru" is also incorrect, it's spelt "through".

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
