Husband has L1 visa, pending 130, can i apply for EAD??

Hello,

I would appreciate any advice.

My husband has an L1 (intracompany transferee) visa and is able to work right now. We married ( I am a US citizen) and the 130 is currently being processed. On this website, when filing for adjustment of status, would it be possible to file for employment authorization as well? even if he has an L1 visa?

I have seen different things.

there is also another form to change visa status? Maybe from L1 to K3?

On the employment authorization form instructions, it states that you do not use that form if you have a working visa to work with a certain employer.

I don't know what to do... 130 should take 5 months and then adjustment of status 3 months. maybe it is not worth applying for employment authorization?

please advice.

My ex husband was on an L1 visa when we met here. We filed an AOS in fear he was going to be laid off and obviously then we would be in a rush to get everything sorted. We did the AOS just like someone who was starting from scratch. We filed for AP, EAD, and obviously the AOS. If for some reason he were to be terminated from his job prior to having a GC he would NOT be able to work...when you are doing the AOS if you apply for AP and the EAD at the same time there's no extra charge so why not just go ahead and cover all your bases?
