CR-1 Visa Annulment

PUSH ... I scheduled an Info-Pass, went to see an officer and the Officer elevated my inquiry to a senior officer. the senior officer ordered the file an I-751 had not been filed to remove conditions. The senior officer reuested a documented time line of events from day 1 thru my appointment date to "paint a complete picture" of what happened. Of what concern could over 800 pages of documentation (all e-mail, all money wire transfers, baby DNA reports, I-129F visa denial.. etc etc etc...) be for her removal of CPR to PR status? She's gonna get PR anyway right ? :)

Yes, unless you can make a convincing case of fraud against her. No one piece of information alone is going to sink her chances but if she lead you to believe her unborn child is yours and you have some evidence she knew otherwise, you may well be able to prevent her from removing conditions. She can't attempt to do so until after the divorce is final.

Facts are cheap...knowing how to use them is precious...

Yes, unless you can make a convincing case of fraud against her. No one piece of information alone is going to sink her chances but if she lead you to believe her unborn child is yours and you have some evidence she knew otherwise, you may well be able to prevent her from removing conditions. She can't attempt to do so until after the divorce is final.

I believe USCIS would like to make a well informed decision from my timeline and cronology document. Thus far its around 800 pages, and with it a pattern of behavior. After reviewing all 700+ of her e-mails, it's obvious the e-mails have several authors. With less than 1 year exposure to english, well structured grammar wouldn't be expected (A Team Effort). DNA test of her baby were negative. She also signed a notorized statement admitting she was pregnant prior to her arrival to the U.S. Providing the timeline, vacating the annulment and divorcing seems appropriate.

You'll want to give USCIS a more concise statement. They aren't going to read 800 pages and sift through them. Using others to help write emails to you is normal, not fraud. Try to focus on the real serious evidence of fraud instead of a shotgun approach.

The chronological sequence in MS Excel is the "Card Catalog" The 800+ documents make up the "library" and USCIS (via Excel)can pull up, sort, filter, serch, edit etc any doc they want. I've decided to opt out of making a case for fraud, USCIS doesn't need that from me. A Documented Chronological Sequence of Events is all that's requested. It makes sense to present it as it is without predisposition. "I-751 - Petitioner's Chronology" all the title will be and below it.... items of interest I find USCIS should consider in making a more informed decision....

Whatever they decide... I will base my doc on documented facts

This is a piece of good news - it 'may be' that ICE will investigate this, and issue a report. The report will go in her casefile, and THEN, when/if she files a ROC case, the ICE report will be IN her casefile- but it's still up to the IO handling the ROC casefile to determine whether or not to start deportation proceedings and/or outright deny the ROC case. Senior ICE Officers may decide to do something, prior, as well.

But - at this point, the most you can do is to 'lob over' a carefully written 'timeline' of her fraud, with any documentation that you can garner.

Hi PUSHBRK.....Annulment granted Feb 2011 for both marriages for fraud. It's been 6 months now and no request for payment from any creditors. How can I be assured I carry no I-864 liability?
