DUI conviction should I be worried?

I'm so sorry that you have experienced this. It is in effect my greatest fear. According to their own guidelines, if this was more than 3 years ago they shouldnt even really look at it. I think you should have mentioned it in the medical to give the doctor a chance to grill you. They basically need to see if the doctor thinks you have a problem and can be refused on health grounds. They may refer you back to the panel doctor who will focus on alcohol. If this was a one off and no one else was involved/hurt and it was more than 3 years ago they shoulnt have held you up.

I was feeling ok, but now I'm really uneasy.

Please keep us posted on how you get on. We're all rooting for you man.

How much do you say you drink now, in units/wk? I would hazard a guess that it's worth cutting out all booze completely until the interview, so you can honestly say that you've stopped drinking.

They may want to do a urine analysis to verify this over a period of time, but again, that is based on somewhat foggy recollection of another VJer's experience.

Timeline Summary:

I think that was Marie620, but I can't find her user id. Maybe she deleted her account.

It was Marie620 but she hasn't posted in a while and only one of her posts is showing up:

My husband had 1 DUI 9 yrs ago, and blew just over the legal limit. No other offences in his life. He was even givena visa to come to America and set up and invest in a company in the states. He was denied his visa in Jan 08 and we have been apart all but 2 weeks since our marriage and when I left July 9th , 2008. We have our Senator involved and is not helping, and now have went to the media for help. I am also meeting with the Director in my senators office next week.

I don't think you should have a problem since it was the doc given you the ok.. but like everyone else has said.. it's up to the Interviewing officer. My husband also answered a question to the doc afor average consumption of 20 pints a week when my husband said month.

They have now deemed my husband a person with a mental disorder and has been not allowed in.

Anyway , wish ya the best luck as this has been the nightmare from hell for me, my husband and our entire family.

Just to clarify this issue for everyone - Panel Physicians do not carry out urine tests. If they suspect alcohol abuse they will request an additional blood toxicology test.

Well, talked to them today. Because my papers say "case to be held in obeyance" they're creating problems. It says that because I havent had a chance to finish my pretrial diversion as im not in the U.S. any more. I now have to wait till next week to see if my passport contains a visa or not when it arrives. She said its going to some review board thats gonna decide...I asked if I could call for status update but she just told me to wait tilll my passport show up

Unless the OP plans to never drink again, he can not use the fact he has not consumed alcohol "for a while" as evidence that he's "stopped drinking". It is a type of fraud to claim he has "quit" when he hasn't. He can mention he hasn't drunk anything in a few weeks or months or whatever, but not that he's "stopped drinking". He can say he drinks, rarely, occasionally, whatever, but not "stopped"

To the OP, the only issue I see is as you mentioned, failing to mention it at the doctor. Some doctors require you to speak to a counsellor to make sure you don't have a problem with alcohol. It being a while ago is apparently irrelevant. It could simply be that you haven't been caught since but being "caught" indicates to them (rightly or wrongly) that you HAD a problem and they want to make sure you're rehabilitated. I've seen some that let you slide, but that recommend you speak to a counsellor in the US

**fingers crossed** for you!

Unfortunately, there was someone just recently who was asked in London to do a urine test with a caution for cannabis possession. Granted, this was for cannabis and not alcohol, but I'm just being a pedant.
