Well, we've been hearing that the k3 visa was obselete and now won't exist any longer. There is only a CR1 and IR1 visa for spouse.

I've read the LingChe's shortcut many times but it's still kinda confusing

ok So, Once you have the 130 approved, USCIS will send your case to the NVC it will take up to 20 days for the NVC to received your case.

PRE NVC

you have to have all the documents required by the NVC before your case is send to the NVC. NVC is fast and you will slow yourself down if you don't have every single document ready before you even start the NVC stage.

1. Get your case #

Call the NVC every day 603-334-0700 use your USCIS case # and see if the automatic system already has a NVC case # for you. once you have a case # at the NVC the automated system will tell you something like this:

This case was entered in the NVC computer system on _______. The case number assignned by the NVC is (Case #). Please allow 6-8 week from this date for the beneficiary to receive the documents"

Tip: putt the nvc phone # + your case # in speed dial so you don't have to dial the whole thing. you will call the NVC and average of 10-15 times per day. because is always busy.

2. Add your e-mail address

So now you have your case at the NVC. press 0 to talk to an operator and let the know your e-mail address your spouse e-mail address this is very important

3. DS3032 and Affidavit of Support I-864 (AOS)

in about 5 days, you will get and e-mail containing these forms. DS3032 is easy to complete. Send it the same day you got it by NEXT DAY Delivery. It will cost you $17.50 don't be cheap.

4. Paying and preparing AOS

So with the DS3032 out of the way you can focus on the AOS packet and and payment. you go to the NVC payment website : https://ceac.state.gov/CTRAC/Invoice/signon.aspx

enter your NVC case # and your invoice id #. that invoice id # should be located in the e-mail NVC send you in step # 3 the amount to pay is $70.00 you pay this fee using your bank acc. Once you pay this bill it will show as "in process" and in about 2 business days maybe one it will change to "PAID" it shows paid, it will let you print a cover sheet. you need this cover sheet so NVC con continue to process your case.

4.a. Preparing the AOS Packet.

ok you need: IRS Transcripts for the last 3 years, Bank account information and statements, employment letter, Last 3-6 pay stubs.

Make sure you put your NVC case # on every page, complete form I-864 that you got on the e-mail (step # 3) make sure you make more

than 24k a year if not get e co-sponsor and send everything next day delivery. triple check everything

4. b. automated messages:

DS3032 Entered in the System:

"...NVC has received the DS3032, Choice of Agent and Address form on______. Please allow 4-6 weeks before you will be notified by NVC..."

AOS Fee Processed:

"...NVC has received the I-864, Affidavit of Support on______. and will send further instructions within the next few weeks..."

5. Immigrant Visa bill form DS230 (IV Bill)

In about 5 business days after step #4, you will received an e-mail containing your IV bill and form (DS230) this is where most people get RFE (Requests for more evidence) don't let this happen to you it will delay your case several weeks this is something you can not afford to do. double triple check every single document that you are about to send, if you don't fell comfortable with a particular document, get the replacement. It better to lose a few days here getting the right staff than losing a few weeks.

The same day you get IV bill e-mail go to the NVC payment site and pay the $400.00 For the IV. wait 2 business days until it shows PAID.

while you're waiting for the payment to post, start preparing your IV packet here you will need:

Completed DS-230 part I & II and ONLY part I signed by beneficiary.

2 passport pictures of beneficiary

Photocopy of the beneficiary's passport biographic data page.

Original/certified copy of beneficiary’s birth certificate.

Original/certified copy of beneficiary’s and petitioner’s marriage certificate.

Original police certificates of the beneficiary in every country that the beneficiary lived for more than six months.

Original/certified copy of divorce decree, death certificate, etc. of previous marriage, if applicable.

Make 2 extra copies of this package. keep one copy for you.

Don't forget to put your NVC case # on every page a mistake here will cost you weeks!

Print the cover sheet once your payment shows PAID, next day the packet you will have the address where to send everything on the e-mail they send you.

5.b. NVC input the case in to their system.

in about 5 business days after you send the DS230, the automated voice respond (AVR) will tell you that they received the DS230 and that it is

under review.

6. Sign in Failed.

7 business days after the NVC entered your DS230 you will try to log in at the NVC website and you will get a message that says: Sign In Failed

Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error.

this is good news, your case will get complete in 1-2 business days.

7. Schedule embassy interview.

Ok last stage at the NVC. So here's how it works: NVC only schedule interview the fist two weeks of every month for the following month. so if you finish your case the 20th of February, you will only know your interview date on first two weeks of March, and THAT interview will probably be for the middle of April.

If you have any questions just post them here. NVC can turn complicated.

Embassy Journey 1.0

March 23, 2010: Interview date. Wife placed on AP, Baby required new birth cert.

April 21, 2010: Wife out of AP she needs to get an approved I-212 from USCIS, Baby birth cert. issue resolved.

I-212 Waiver @ USCIS Journey

May 10, 2010: Filed form I-212

Sept. 9, 2010: I-212 Approved

Embassy Journey 2.0

Sept. 22, 2010 New Interview date.

Sept 22, 2010 VISA APPROVED.

Waiting for visa to arrive at Cali-Colombia.

ok So, Once you have the 130 approved, USCIS will send your case to the NVC it will take up to 20 days for the NVC to received your case.

Wow, I can't tell how grateful I am reading this. Thanks alot for breaking it down.

Every documents will be sent when preparing the AOS packet right? I wouldn't like that we get an RFE which may slow us as you suggested.

Would you pls share with me again what documents I should start getting ready now beside the IRS transcripts and my work documents.

From your experience, pls advice me on what documents we should get ready and have at hand while we continue to wait for our NOA2.

Thera are two packets.

packet # 1 AOS:

Documents needed:

Completed I-864 Affidavit of supports.

Packet # 2 DS230:

OK. IRS Transcripts are easy to get. I got mine the same day I request them by fax. I also request them by mail it took 5 business days to get them.

Police records are very difficult you may be even late already to get those. I took me a month to get it from my wife in Colombia.

One more tip. tell your spouse to download the form DS230 and sign part # 1. She is going to have to send you several thing from her country like the pictures, police cert. etc so take advantage and send this form signed already.

Maybe I'm missing something so don't just use my advice. Research more and make sure you have everything. Here's where it makes the difference I have seen cases at NVC stuck for 3 even 4 months. Also, I have seen people done with the NVC in 3 weeks.

Mine took 24 business days and I lost several days getting documents. I could have done it in less than that.

Thanks again for responding. Actually I'm filing for my Husband who live in Chile. He already has his police certificates now. Will ask him to download the DS230 and sign. Will be sending marriage bonafides and proof of marriage like we did when filing the I-130? Whatelse should we get? The distance is really hard and we miss each other every minute. I would be glad if we go through this the fastest way possible. It's good learning from people with experience. Continue advising us pls.

What documents are you talking about? Evidence of bonafide marriage among? can you tell us what the documents which you mailed off are? Who's email address should be used? should it be that of the petitioner or beneficiary?

Beneficiary: Get NVC# + receive DS3032 + send DS3032+ DS3032 accepted + IV fee bill available to be paid + pay and wait to show paid + print IV cover sheet + mail DS230 package with all original/certified documents

= wait for case complete + wait for interview to be scheduled.

Are we suppose to be sending original documents or copy? Shouldn't we be including joint assets or bonafide during those stages? Or they have to be at the interview alone? I thought we will be sending them proof of ongoing relationship, police certificate, marriage bonafide documents, beneficiary passport, birth certificate etc. I'm confused.

Your stuff will be evaluated at the consulate level and you will skip through the NVC stage. Once NVC receives your petition from USCIS, it will assign a case number and send it on its way to the consulate.

Btw: 2 passport pictures needed with the DS230 packet. Not four. Two.

And two more for the medical.
