Our son has Dual citizenship. He has a US birth abroad birth certificate and an American passport. We have applied for his Canadian passport as well. Looking over some of the forms that will be coming soon, I am at a loss as to how to list him.

When filling the I-134 and I-156k it asks about children accompanying or following. Well our son isn't going thru the immigration process so i'm assuming we should file him on her forms as if he is already living in the states, but we are concerned that we shouldn't put that since he is still living in Canada. How should he be listed in those forms or do we list him at all? Do we check accompanying or following? thanks for any help here

Our current timeline:

Met online Oct 2004

Met in person June 2006

Engaged Oct 2007

Son born Leap day 2008

Birth Abroad applied for in Toronto, ON Sept 9th 2009

Birth Abroad Certificate received Sept 24th 2009

I-129F submitted October 21st 2009

NOA1 received October 26th 2009

NOA2 received February 2nd 2010

NVC received February 19th 2010

left NVC February 22nd 2010

consulate received February 23rd 2010 ( wow 1 day !?!? )

Packet 3 received March 4th 2010

getting packet 3 ready.....

It's my understanding that you don't list him on these forms, as you're not applying for a visa for him. He'll enter the US with his American passport and isn't subject to meeting any immigration requirements, to the best of my knowledge.

The accompanying or following simply tells them if they are processing a visa now or if they need to deal with the dependent's visa at a later date.

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017

I was thinking we wouldnt list him except that it says "all children, date and place they were born" wasnt sure if they were meaning any children we had or just children that would need a visa too. I would hate to not put him on the forms and then they say we werent being honest as to the children we have. Maybe I am just over thinking this stuff. So stressful worrying about putting something wrong on the forms and it cost us our visa :wacko:

Read the instructions carefully and respond accordingly. When asked to list any children list all children. When asked who is accompanying you, answer that directly. It's ok to add a note that the child is a US Citizen traveling on a US passport.

Facts are cheap...knowing how to use them is precious...
