Ok so previously I had posted a question. I was denied in customs about 7 months ago due too not having enough ties to Canada. So the customs agent took my fingerprints and told me to try again in six months.

Now this six month ban does this usually happen when you are denied at the border?

If you are going to get denied, you are going to get denied at the POE (port of entry), ie-traveling from Canada to Chicago....when you arrive in chicago, they can deny you when you are trying to enter the country.

Bring as much ties to Canada as you possibly can....if you own a house, show your mortage, get a letter from your boss (that is signed by him/her) stating that you are employed full/part time and are leaving from date to date for a vacation and are expected to return on a certain date. make sure that you put in this letter the title of your boss and possible contact information. if you are in school, show a class schedule.

bring a copy of your return stub back to your foreign country. hope that helps.

To answer your question, I've never been denied but I do know of several people that have been denied and went back the next day with no issue. It was most likely a recommendation. I wouldn't be worried about it at all.

It's not a big issue but now that they flagged you with "prints and pictures' along with the date and reason for denial, that will pop up when they scan your passport, be sure you have your ties to Canada ducks in a row next time!

Hi I got denied in Oct last year due to lack of ties to Canada too. By then I just moved back from Hong Kong to Vancouver with no job and no house (I stayed with my parents). They told me to try six months later and show them ties.

My question is now that my fiance has submitted a I-129F petition and we have just started our long journey. However, I still have no job and no house (still staying with parents) but I'm selling on ebay. So what if when my K-1 visa is approved but I still have no jobs during these couple months and I'm trying to enter USA with a K-1 Visa? Will I be denied of entry for the reasons that I have no ties to Canada? I read from someone's thread here that he got denied at POE even though he had his K-1 on hand. I'm very anxious. What should I do to prepare? Thanks!

I seem to recall reading that when they give you a ban, whether it be months or years, they actually mark something in your passport to that effect. Did they write or stamp anything in your passport about the 6 months? Not that it matters now, since the 6 months has passed.

You will DEFINITELY need to have, on your person, evidence of VERY STRONG ties to Canada before you try again. (And even at that, success is by no means a given, as you well know.) I would recommend having, in addition to all of the evidence you can find regarding employment, rent/lease/mortgage documentation, that you have a copies of your I-129F NOA1 and your ENTIRE I-129F packet on you. Those latter two are considered by CBP as very good evidence that you intend on doing this right, and have in fact already invested $500 towards doing it properly.

When your K-1 is approved and you go to enter the US, you will be entering the US with the intention of moving there permanently and adjusting your status to that of permanent residence. In actual fact, once you enter the US, you will be completely UNable to, without badly screwing up your life, return to Canada, for a minimum of 2-3 months [until you have an AP document or Green Card in your hand]. Ties to Canada would be completely beside the point :)

If someone was denied entry to the US with a K-1 visa in hand, it would be for a reason completely unrelated to having immigration intent. The K-1 visa is what allows you to have immigrant intent. I don't know why someone would be denied, but inadmissibility due to possession of controlled substances is the first obvious thing that comes to mind.

I wouldn't worry about it. The worst thing you have to fear at the PoE will be a cranky border officer. If you've got the visa, then you've done everything right to that point, and the PoE should be a formality. Worst realistic case scenario is a long, tedious formality. Don't worry about it :)

Thank you. That's exactly what I was told couple month ago by some senior members here and their answers made sense to me. K-1 visa is non-immigration visa with immigration intention. I was just getting anxious and paranoid when I read the thread about the member who had the K-1 on hand and still got denied at POE. May be I need to re-read his thread and understand why he got denied. Being finger printed and detained 4 hours at POE was a really horrible experience. :huh:

There was a case recently of this happening. She was turned away because of something in her legal history, that was disclosed, discussed and assessed at the embassy as not being grounds for inadmissibility, but the IO at the POE disagreed. The buck technically stops with them. The beneficiary in question kicked up a stink (understandably!) and was re-issued her visa, with reassurance from the embassy that it will not happen again. To the best of my knowledge, she's now in the US.

The only time you'd be turned away with a K1 is if there is something that they know about that wasn't picked up at interview or if they feel they have to veto the embassy's approval. In other words, if you don't have any problems in your legal past, you really shouldn't have anything to worry about.

Doesn't sound like a ban, but rather a recommendation. His way of saying that trying again before the 6 months is up will probably result in another refusal. Yes, you were denied entry but you weren't banned. A ban would be as a result of something else (previous overstay, for example) and the official lengths of formal bans are either 3 years, 10 years or lifetime depending on the severity of the grounds for the ban.

I had a 6 month ban on my passport to visit England. Now when going to the UK, I never was denied entry but was told to leave for 6 months in between my next visit. It's actually happened to me twice, Both times I waited the 6 months and had no problems. and both times the 6 month ban were stamped in my passport.
