Timeline

Hi November filers,

My fiance just received the Receipt Notice, this is the noa1 right? Notice date is Feb 03,2010.

We submitted our papers in November 17, 2009. In our status online it says they received it on Nov 17, 2009.

We thought that this would be the noa1 date but its not.

My fiance and I met in person in feb 2, 2008 and did not meet again in between.

Our concern is Feb 2, 2008 (first meeting) to Feb 02, 2010 (Notice date is feb 3)

our meeting within 2 years expires. waaaaa

Does it mean that we will be denied?

Please please your response is highly appreciated.

12/09/07 We met online

02/02/08 We met at Mactan International Airport :-D

11-17-09 Mailed I-129F to CSC

11-17-09 NOA1 dated

11-19-09 Check cashed

02-03-10 Touched. Said they will mail the Receipt Notice within 30 days!

02-06-10 Receipt Notice hard copy arrived. Notice date is Feb 03, 2010.

03-02-10 NOA2 :-D what a glorious day!

04-27-10 Medical Exam at St Luke's in Manila

05-03-10 Inerview at US Embassy Manila

05-15-10 My flight to LAX

05-26-10 Wedding day!

08-10-10 Submit AOS packet

11-09-10 Biometrics

11-24-10 Received EAC

01-04-11 Interview.. Approved! The interviewer was from Cebu also :D

01-13-11 Receieved my greencard.

I dont think you can be denied for that reason. However you will have to tell them why you havent seen each other within the last 2 years.

Try not to get to hung up on this issue. Just be honest. Always be honest.

Dec 25 2009 officially engaged

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Uh, it looks like you were approved already? Your sig timeline has an NOA1 in November, which means the second one was probably an approval/denial. In any case, I believe as long as it was 2 years before NOA1, you're good to go.

Are you SURE that the notice you just received was NOA1? Because it sounds like it should be NOA2 given your timeline. If it was the NOA1 it would say on it "receipt" and ignore the date on that, is there a "we received your petition on ####"

I hope that the notice you have is the NOA2 (notice of approval) otherwise you MIGHT encounter a problem. I hope you took a screen shot of the online status showing when it was actually receivied. I would think though that you would not have received NOA1 because I have heard of people simply having their cases returned because they didn't have the "met in the last 2 years" requirement. *fingers crossed* for you

We never received the NOA1 hard copy in November. In online status dated Nov 17 they said they mail it already plus its the date at the back of the check. so we assumed its the NOA1 date. We followed up and the first notice arrive today.

It is not notice of approval, so yes it is the NOA1, My fiance said It did not say any date like the date they received the file.

It's a GOOD idea to make another visit regardless. Multiple meetings are a plus for the interview as they most always ask how man times you have met.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

No there doesn't. I KNEW my husband for long enough and that's what mattered to them. I had proof of our relationship and I had only met him in person once, and for a period of 2 months.

Could be a Philippines thing but definitely no need for more than one visit unless you're missing relationship proof.

The Philippines is regarded as a high-fraud country. Australia is not. The consulate in Manila must be more vigilant and interviewers must be sure that the engagements are real, not created for visa purposes.

Ouch that hurts! Thanks for that saying about my country being regard as high fraud country. lol no biggy! In my opinion its ok if He won't visit you again. As long as there's a continuation of communication. If interview comes keep proof of relationship. Phone call bills, emails, chat history.

Just wait for the next notice of action it will take weeks or at least a month.

Just be honest about your relationship and proof is a must! Be sure to have a strong evidence of relationship. :)

K1 visas in the Phils is so easy get. As long as no suspicious situations. Few k1 visas in the Phils is denied in my knowledge. Mine took 3 months of process. ^^

I think you're safe, the requirement says "must have met in person within the two-year period immediately receding the filing of the petition" Your petition was filed on the 17th of Nov. and it still within the 2 year window.

as to multiple visits, Immigration people follow certain sets of rules, regulations and requirements...doing the minimum requirement is all they need...

You will be fine...sounds like there was the same type of mix-up as with mine in november. My online status never changed until I was able to call and request another expedite..then I found out I had an RFE (I was in kuwait at the time and mail was going to alaska). Good luck and be patient, NOA2 should be coming soon!

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I cannot fathom not seeing someone for almost 2 years and marrying them. I would encourage another visit if not to support your own case, but to make sure you truly can live with the person. We dated 5 1/2 years and had 8 visits, many for just shy of six months at a time to ensure we were going down the right path. It is not that either of us ever had any questions from day one but I'm so thankful nonetheless to have had all that time together to insure there was no doubts by either party.
