Timeline

Hmm, well recently my wife left me, so here I am, the British Citizen with Conditional Permanent residence. (still waiting to hear back about the conditions being removed, its been a couple of months) I have been married for 3 years on August 12th, have been in the US 2 years and about 2 months. The marriage was entered into with good faith and I never foresaw something like this happening... clearly im probably going to have to talk to a lawyer, but any heads up would be appreciated.

I have a 2 year old US citizen son, so I mean surely immigration wouldnt boot me out of the country right? Im the only one that can support myself and my son since she has a retail job (working 20 hours a week) anyone? Kind of worried right now about everything :/

09/07/12 - NVC Received

10/04/12 - Packet 3 received in US

10/23/12 - Interview - (Juarez Consulate) APPROVED

I-485 AOS

01/28/13 - Submitted I-485, I-765 to Chicago via USPS Express

01/29/13 - USPS Delivery Confirmation

02/03/13 - Email/Text Acceptance Notification

02/04/13 - $1070 USCIS Transaction Cleared

02/06/13 - Received NOA1 for I-485 and I-765 in mail

02/11/13 - Received Biometrics appointment, set for March 4th.

03/04/13 - Biometrics complete

04/01/13 - EAD Card production ordered according to USCIS case check

04/04/13 - EAD Card Received

02/20/14 - Put in a service request with USCIS. No update on Case Status online since June 2013 (Address change). Still in Initial Review.

02/28/14 - Contact Congressman Randy Hultgrens office to investigate delay

03/06/14 - USCIS Case online changed to reflect Green Card is in production

I-751 ROC

03/07/16 - I-751 received

04/06/16 - Biometrics complete

??/??/?? - Received work authorisation, lost form :(

09/01/16 - Got I-551 stamp in passport to travel to europe, only given 6 months

Robjb,

You've already applied for removal of conditions? Before the separation? Was the indication in the application documents of pending marital problems? Many I-751 applications are approved without interview.

Your son will not prevent you from being expatriated should your I-751 be denied.

There is nothing to suggest it would be denied.

Hi! You should be fine and not gonna be denied. You might gonna be approved without an interview.,but if you or she is planning to file for divorce before the I-751 approval or already divorced, you should resubmit the new I-751.

Thanks guys and gals. We are separated but have not filed for divorce yet. When I applied to remove the conditions we were still together and I didnt foreseee what was soon to happen. I guess im just a little worried also because I was late sending off my change of address forms, one time a couple of motnhs late, the other time a whole year late... :o Well, I will wait and see. Assuming the conditions get removed and there are no problems, do I need to do anything else special to notify them that I am getting divorced?

HI! Did you say that you are Legally Separated? As far as i know that being Legally separated is very close to be as being Divorced .Did you file some papers for to be Legally Separated.?...

If i understood you correctly you need to resubmit a New I-751 in this case... .....

If you mean that you are just Separated by the means that she left you without filing any papers for the legal separation, thats another story...,i dont know,you probably dont need to do anything in this case ,just wait and see....she might come back to you... ;) ,but i would suggest to you to contact an immigration attorney about your case as the attorney would give you a good legal professional advice.

Also, If you are going to be divorced while your I-751 is pending,you should notify the USCIS immediately by mail and by phone. After the divorce is final you need to resubmit the new I-751 .

Also you should call them and make sure that they have Changed your adress in computer as they might send you the important mail or the Card to the old adress,in case if the computer doesent indicate the New Change of Adress.

We have Changed the Adress and notified them about the Change within 10 days,but i have received the Approval letter on our New Adress ,but the Green Card was delivered to the Old Adress,thanks God my husband found it there as the old house was still on Sale at that time. :hehe:

No no no, he means that once when he moved he sent the AR-11 a couple months late, another time when he moved again he sent it a year late. Not that that's how long they lived together for! :)

There is no legality in our separation, she left and moved in with her mother, I just recently moved to a diff apartment since she started seeing a guy and i dint like the fact that my apartment was facing her mothers apartment :/

We have lived together constantly for the almost 3 years we have been married and longer before that, I just meant that we had moved a couple of times within the US (same state) which is where I forgot to do the change of address

HI! If you have moved to a new adress again ,you need to file a new Ar-11 and I-864-Sposnsor;s Change of Adress,but since that you are not living together anymore., i dont know if your wife would agree to file the

I-864.Just file the Ar-11 as i have heard alots of people forget to file the I-864 and seems everything is fine as basically its not your responsibility to file the I-864 ,its her responsibility theoretically....

You should talk to the immigration attorney or just wait and see i guess, but since you had to move a lot i am concerned that the INS will be confused with your Change of Adresses all the time., so make sure that your adress have been changed in their computer system..

You do this everytime someone posts that the marraige has or is ending.... you try to twist things and pick peoples posts to try and catch them out in some way.....

I know you have been hurt and I know you have not delt with it and moved on in your life.... but please dont do this to others... they come here for a little bit of support... they dont need you being negative all the time....

So the OP was late in doing his AR-11 so what.... dont tell me you have never forgoten to do something.....

Now please back off and leave this guy alone....

What's wrong with me asking such a valid question? I would assume that if the OP forgot to change his address with one Agency, he must've also forgotten to change it with the other as well! Right?

July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.
