Hi Canadian folks,

I'm preparing my adjustment of status forms, and this is what I have so far for things we're going to include (mostly excerpted from my cover letter):

- Cover letter

- Payment in the amount of $1010.00.

- I-485, Application to Register Permanent Residence or Adjust Status

- G-325A, Biographical Information for Spoom

- I-693, Vaccination Record (Note: Full medical is not required as this package is being filed within one year of a K-1 immigration medical examination having been performed abroad, per I-693 USCIS instructions, Section III, question 2, and the K-1 examination did not reveal any Class A medical conditions.)

- I-864, Affidavit of Support

- Copies of ScooterMac's federal tax returns for the past three years

- Letters from ScooterMac's employers verifying yearly salary and ongoing employment

- I-765, Application for Employment Authorization

- I-131, Application for Travel Document (Advance Parole)

- Copy of Spoom's Canadian Passport, including K-1 visa and I-94

- Copy of Notice of Approval for K-1 petition (NOA2)

- Certified copy of marriage certificate

- Two passport-style photographs of Spoom

- Photographs of wedding ceremony and reception

- Letter from Pastor verifying ceremony and relationship

Do I have everything, or are there more things I should be including to make my package more complete? Also, do I need copies of all pages of my passport, or just the biographical page and the pages with the visa / I-94?

Have you prepared the I-485, the I-131 and the I-765 as separate packages with their own separate attachments? They are submitted together but divided up when received and processed separately so each one needs to be a stand alone application.

Are the tax returns as transcripts or as actual returns? If as actual returns, then all of the attachments, W-2s and schedules also need to be included.

Other than that, it looks good. I don't believe all of the pages of the passport are required - just the identification and the I-94/K-1 page. Good luck.

I didn't put a seperate cover page, but I did make sure to attach a copy of my marriage cert, the I-94 and my bio page for each package.

For the transcripts, it only took about 2 weeks for Wes to get his, not sure if that will be longer atm though due to it being tax time.

Did you include prof of ScooterMac's citizenship Spoom? This is something that needs to be included with the I-864. You can include a photocopy of his passport bio page, birth certificate, or naturalization certificate.

How about passport photos? You need to include 2 with each application, so 6 all together.

And, you'll need a copy of your Canadian long form birth certificate to include with the I-485.

Here's a copy of the cover letter I used. This is borrowed from SapphireDreams who borrowed it from JillA. It has been modified slightly along the way but the structure of it is pretty much the same! This may or may not help, but sometimes its nice to compare with others.

Form I-485, Application to Register Permanent Residence or Adjust Status

Package Includes:

• 2 passport standard photographs & receipt for photographs (date on the receipt to show they were taken within 30 days of the filing of this application on August 16, 2009)

• Check in the amount of $1010 made payable to the Department of Homeland Security

• Copy of filing alien’s foreign birth certificate (Ontario, Canada)

• Copy of passport page with K-1 Visa

• Evidence of eligibility which includes: a copy of approval notice for I-129F (NOA2), copy of marriage certificate showing legal marriage within 90 days of entry into the USA, Form I-94 (front & back), and Canadian passport identity page

• Vaccination supplement (Vaccination Documentation Medical Worksheet) and supporting evidence of follow-up Gardisil shot

• Form G-325A, Biographic Information Sheet

• Affidavit of Support (Form I-864) which includes: tax documents, letter of employment from American spouse, recent paystubs showing sufficient income, also proof of U.S. Citizenship which includes copy of the biographic data page of sponsor’s U.S. Passport

Form I-131, Application for Travel Document

Package Includes:

• Letter of request for granting Advance Parole

• 2 passport standard photographs (which were taken on August 16, 2009 – receipt attached to Form I-485)

Huggles: I only included 2 photos on mine and got my AP and EAD. I think they dont even use your passport photo for your official picture -- they use the photos from your biometrics now. I might be wrong, so maybe its better to include 6 and not 2.

I would definitely include the supplementary page that you receive from your medical. I did not add mine, so I wonder if that is why I got an RFE for the medical.

I did not put the application in separate pages -- what I did was separate them by a HUGE paper clip. I did put a cover page detailing what each application included (ie. I-485 has these, I-764 has these, etc.)

I only submitted the biographical page of my passport, as well as the I-94 and the K1 visa.

I also included a copy of my husband's passport biographical page to prove his citizenship.

If I remember, I -think- you only need your transcript and W2 from the last tax year (2008). You need to fill the tax information for the last 3 years, but only need to show tax return from last year. You can include the last 3 years though. My husband was still in school til 2007 and worked part time so he can take the CPA in 2008 -- thus the income showed from his 2008 tax return was not enough. However, he included a copy from his employer stating that he is a full-time employee and has worked since this time, and we did not get any RFE from that.

I would say that you should bold-face/emphasize all the documents that you are including in your application. I got an RFE for the medical -- they said I did not have one, but I did. When I looked back in my original cover letter, I realized I did not bold-face the I-693, and I think that is why they asked for the medical evidence.

Really Darkchilde? Well maybe you only need 2 then, for the I-485. I'm just going by what I was told by others when I filled back in August. Then again, you may have just got lucky, I don't really know. They use the passport pictures on your AP, I know that much, and then they use the biometrics photos on your EAD and your GC.

And you're right about the tax return. Technically you're are only required to submit your 2008 tax transcript. Adding in 2007, and 2006 are voluntary if you feel they will help your case. I sent mine just to be safe, and because I thought they would help. If you need your transcripts fro IRS quickly, I've heard of some people calling and having them faxed the same day. I'm not sure if that option is still available, but I've read that a couple times here on VJ.

I didn't even send the I-693 and I didn't get an RFE, but lots of people have, and some people who actually included the I-693 still got an RFE. I don't get it at all!

Mine was all from the biometrics. Not sure if its a new thing -- I read from the AOS forum that USCIS have started using the biometrics photos for all the applications, but attached 2 photos anyway in case. Im glad they used the biometrics one, the passport photos I gave were HORRENDOUS :P

I know this sounds crazy, but I think there was some kind of policy change from when the summer K1 filers applied for AOS and when the fall K1 filers did. I think my batch seem to have just gotten transferred... it does seem redundant to have both an interview for a K1 then a few months later another interview for the GC. I know, it sounds insane, but the Canadian trend shows such! Anyway that said, maybe that explains the new photo thing and the fact that they are stricter with the I-693.

I included my SSN with the application. In Indiana, things are slightly different because the name change occurs at the social security office. The marriage certificate still had my maiden name on it.

We also ended up sending a G-325A for my husband (the USC). We figured it doesn't hurt to send them more info. We already had 2 photos for him, so we might as well send it.

I didn't send any proof of wedding or anything like that. If your called to an interview, then you would need it.

Like others have said, I made separate files for AOS; AP; and EAD. I also included copies of my visa, I-94 and marriage license, (certified) with each packet, and pic's for each. My AP and EAD look as if they were the ones I had sent in. So it is possible things have changed in that short time. Oh yeah. copy of long form BC. and I can't remember if I sent in any proof of Tim's but I probably did.

Does anyone know If the Birth Certificate of the beneficiary is required (if yes, then copy or original?) in the AOS packet, or does the beneficiary passport copy suffice and prove her nationality?

I believe that you'll need a copy of the beneficiary birth certificate.

Yeah, I remembered I forgot about the birth certificate earlier, I'll definitely have a copy of my long-form one (which I still have from the K-1). I'll also get another copy of ScooterMac's passport (or reuse the one we had before since I think I still have it).

G-1135 is so that USCIS will email and/or text you when your petition is approved. It's just a short form with your cell phone number and email you clip to other forms to get them to do that.

The medical results... The thing about that is that I only have a page saying that I have no issues with my lung X-ray, and a copy of the vaccination supplement. The rest was either given to the Consulate or submitted in the sealed package to USCBP at the POE. Am I still going to be OK with just getting the vaccination supplement transcribed and sealed into an envelope by a Civil Surgeon?

Also, how likely are they to grant a multiple-entry AP on just wanting to see my Canadian family occasionally?

PS: I'm the guy, ScooterMac is the girl :)

Just follow the guidelines to submit AP on VJ -- thats what I did. I ended up having 2 copies of the AP, and it states that it is valid for multiple entry good for a year. I think you can use that as your "visa" to leave and enter the US. Seriously though, you might get your GC as soon as you get AP -- I got mine last week and my GC was already transferred to CSC for "faster processing".

I dont think we included my husband's BC but we definitely showed his US passport.

Sorry about that! I should have realized ScooterMac was the girl since she posts in the wedding thread every now and then. Usually men don't venture into the wedding thread :lol:

I went to get my vaccinations transcribed by a Civil Surgeon and all I had was the vaccination supplement and that x-ray sheet and they transferred everything over without a problem. Of course, after I went to the trouble they didn't even want it at my interview...

For the AP, I used the example letter here on VJ and just made up dates I would have ideally liked to visit on. They aren't going to bother researching and seeing if you actually used it when you said you would. I never ended up using mine at all.

I didn't even know about the G-1135! That's a new one to me.
